Ms. Jani learned advocate for the applicant has<br \/>\nsubmitted that in present application any relief against the said<br \/>\nopponent No. 4 has not been prayed for and the opponent No. 4 would<br \/>\nnot be directly affected party if the order as prayed for in the<br \/>\napplication is granted and that therefore she has sought permission<br \/>\nto delete opponent No. 4 from present application.\n<\/p>\n<p>\tLeave<br \/>\nas sought for is granted. The opponent No. 4 is permitted to be<br \/>\ndeleted. The applicant shall carry out necessary amendment forthwith.\n<\/p>\n<p>\tBy<br \/>\norder dated 23.8.2004 the first appeal No. 215 of 2004 has been<br \/>\nadmitted.\n<\/p>\n<p>\tBy<br \/>\nvirtue of another\/prior order dated 22.3.2004 ad-interim relief in<br \/>\nterms of paragraph 3(a) in Civil Application No. 820 of 2004 was<br \/>\ngranted with direction to the appellant-Insurance Company to deposit<br \/>\nthe entire decreetal amount along with the costs and interest. Ms.<br \/>\nJani learned advocate for the applicant-appellant-Insurance Company<br \/>\nhas submitted that the amount as directed by the order dated<br \/>\n22.3.2004 has been deposited. By subsequent order dated 23.8.2004 the<br \/>\nCourt permitted the original claimants to withdraw 40% of the<br \/>\ndeposited amount and balance 60% of the amount was directed to be<br \/>\ndeposited with a Nationalized Bank.\n<\/p>\n<p>\tHaving<br \/>\nheard Ms. Jani learned advocate for the appellant and Mr. Mithani<br \/>\nlearned advocate for the original claimants and taking note of the<br \/>\nfacts that the opponent Nos.  2 and 3 are not present, ad-interim<br \/>\nrelief granted by order dated 22.3.2004 read with subsequent order<br \/>\ndated 23.8.2004 is confirmed on the same terms and conditions and the<br \/>\ninterim relief shall enure on the same terms and conditions until<br \/>\nfinal decision in the appeal or until any other or further order is<br \/>\npassed.\n<\/p>\n<p>\tThe<br \/>\nCivil Application stands disposed of.\n<\/p>\n<p>(K.M.THAKER,J.)<\/p>\n<p>Suresh*<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court United vs Saminaben on 18 March, 2010 Author: K.M.Thaker,&amp;Nbsp;
