Justice V.GIRI\n\n Dated :12\/06\/2009\n\n O R D E R\n                        V.GIRI, J.\n                  -------------------------\n              W.P.(C).No.15492 of 2009\n                  -------------------------\n          Dated this the 12th day of June, 2009.\n\n\n                        JUDGMENT\n<\/pre>\n<p>          Heard learned counsel for the petitioner and the<\/p>\n<p>learned Government Pleader.\n<\/p>\n<p>          2. The petitioners entered into an agreement for<\/p>\n<p>sale of 32 cents of property comprised in different survey<\/p>\n<p>numbers in Block No.16, Ward No.5 of Koppam Amsom,<\/p>\n<p>Palakkad, as evidenced by Ext.P1. The consideration in the<\/p>\n<p>agreement is Rs.12,80,000\/-. Pursuant thereto, a sale deed<\/p>\n<p>was drawn with the first petitioner conveying the property<\/p>\n<p>in favour of the 2nd petitioner as per Ext.P2. Ext.P2 was<\/p>\n<p>submitted for registration. The 1st respondent refused to<\/p>\n<p>register Ext.P2 on the ground that the consideration shown<\/p>\n<p>in the document is far lower than the value of the property<\/p>\n<p>shown in the original title deed, bearing No.1855\/07. It is<\/p>\n<p>in these circumstances, the writ petition has been filed<\/p>\n<p>praying for the following reliefs:<\/p>\n<p>W.P.(C).No.15492 of 2009<\/p>\n<p>                              :: 2 ::\n<\/p>\n<\/p>\n<p>      (a)   issue a writ of mandamus or any other<\/p>\n<p>            appropriate order or direction directing the<\/p>\n<p>            respondents to register the Ext.P2 Sale Deed<\/p>\n<p>            for the consideration which passed between<\/p>\n<p>            the parties without determining the market<\/p>\n<p>            value of the property;\n<\/p>\n<p>      (b)   to issue a writ of prohibition prohibiting the<\/p>\n<p>            respondents to compel the petitioners to<\/p>\n<p>            quote higher value in the      Sale deed as<\/p>\n<p>            consideration   contrary    to   the    actual<\/p>\n<p>            consideration passed between them for the<\/p>\n<p>            sale of the property;\n<\/p>\n<p>      (c)   to grant such other and further reliefs as that<\/p>\n<p>            are warranted under the law this Hon&#8217;ble<\/p>\n<p>            Court may deem fit and proper in the interest<\/p>\n<p>            of justice.\n<\/p>\n<\/p>\n<p>         3.    The Sub Registrar refused to register the<\/p>\n<p>document merely because, according to him, the property<\/p>\n<p>is undervalued.    If a fair value of the property, as per<\/p>\n<p>Section 28A of the Registration Act, is published the<\/p>\n<p>document cannot be registered, at a value lower than the<\/p>\n<p>said value. The reason stated in Ext.P3, the communication<\/p>\n<p>issued by the Sub Registrar, refusing to register the<\/p>\n<p>W.P.(C).No.15492 of 2009<\/p>\n<p>                             :: 3 ::\n<\/p>\n<p>\ndocument is that the value of the property in the prior<\/p>\n<p>document to Ext.P2 is Rs.67,20,000\/- and the value shown<\/p>\n<p>in Ext.P2 is Rs.12,80,000\/-. This, as stated above, is not an<\/p>\n<p>adequate reason for refusing registration. The petitioner<\/p>\n<p>relies on Ext.P5 notification wherein the value of the land<\/p>\n<p>lying within the Palakkad Municipality is shown. In these<\/p>\n<p>circumstances, the Sub Registrar is bound to register<\/p>\n<p>Ext.P2.    But, this does not prevent him from taking<\/p>\n<p>proceedings against the petitioner for realising deficit<\/p>\n<p>stamp duty and for realisation of penalty in accordance<\/p>\n<p>with the provisions contemplated by Section 45 B of the<\/p>\n<p>Stamp Act.    I make it clear that the directions which I<\/p>\n<p>propose to issue is only to register the document. It is not<\/p>\n<p>an expression of my opinion on the correctness of the<\/p>\n<p>consideration shown by the petitioners in Ext.P2 document.<\/p>\n<p>It will be perfectly open to the Sub Registrar or any other<\/p>\n<p>authority to take action under Section 45 B of the Stamp<\/p>\n<p>Act or any other enabling provision in the Statute.<\/p>\n<p>W.P.(C).No.15492 of 2009<\/p>\n<p>                              :: 4 ::\n<\/p>\n<\/p>\n<p>          4.
