Justice K.T.SANKARAN\n\n Dated :19\/10\/2010\n\n O R D E R\n                 K.T.SANKARAN, J.\n          ------------------------------\n             W.P.(C).No.31330 OF 2010\n          ------------------------------\n     Dated this the 19th day of October, 2010\n\n\n                     JUDGMENT\n<\/pre>\n<p>    The petitioner was appointed as LPSA in NLP<\/p>\n<p>School, Manaly, Kechery, Thrissur District with<\/p>\n<p>effect from 5.6.2002.  The appointment was approved<\/p>\n<p>by the Assistant Educational officer. It is stated<\/p>\n<p>that  from  2006-07  onwards,  the  petitioner  was<\/p>\n<p>accommodated  against  the  anticipated  additional<\/p>\n<p>division  vacancies.    While  so,  C.Vijayakumari,<\/p>\n<p>Headmistress of the School retired from service on<\/p>\n<p>31.3.2010. The claim of the petitioner is that she<\/p>\n<p>ought  to  have  been  adjusted  against  the  said<\/p>\n<p>vacancy  from  1.6.2010   in  the   light  of   the<\/p>\n<p>Government Order dated 9.11.1999 and the decision<\/p>\n<p>in <a href=\"\/doc\/1624030\/\">Geetha S. v. Jeo Thomas K and others<\/a> (2009(4)<\/p>\n<p>KHC 296).    Though the petitioner requested the<\/p>\n<p>Manager to appoint her against the vacancy from<\/p>\n<p>1.6.2010, the Manager declined the request.  On the<\/p>\n<p>other  hand,   the   Manager   appointed   the  4th<\/p>\n<p><span class=\"hidden_text\">W.P.(C).No.31330 OF 2010     2<\/span><\/p>\n<p>respondent, who according to the petitioner is a<\/p>\n<p>fresh hand.    Aggrieved by the appointment of the 4th<\/p>\n<p>respondent,      the     petitioner      filed      Ext.P7<\/p>\n<p>representation    before   the   Assistant    Educational<\/p>\n<p>Officer.\n<\/p>\n<\/p>\n<p>    2. The reliefs prayed for by the petitioner         in<\/p>\n<p>the Writ Petition are the following:<\/p>\n<blockquote><p>     &#8220;i)  issue   a   writ  of   mandamus   or  other<br \/>\n         appropriate    writ   order   or    direction<br \/>\n         commanding the 2nd respondent to approve the<br \/>\n         appointment of the petitioner from 2006-07<br \/>\n         onwards.\n<\/p><\/blockquote>\n<blockquote><p>     ii)  issue  a   writ   of   mandamus  or    other<br \/>\n         appropriate    writ   order   or    direction<br \/>\n         commanding the 3rd respondent to accommodate<br \/>\n         the petitioner as LPSA against the regular<br \/>\n         vacancy arose from 1.6.2010.\n<\/p><\/blockquote>\n<blockquote><p>     iii) issue    a writ     of mandamus   or   other<br \/>\n         appropriate    writ   order   or    direction<br \/>\n         commanding the 2nd respondent to effectively<br \/>\n         consider and pass appropriate orders upon<br \/>\n         Exhibit P-7 after affording an opportunity<br \/>\n         of being heard to the petitioner within a<br \/>\n         time limit before granting approval to the<br \/>\n         4th respondent.\n<\/p><\/blockquote>\n<blockquote><p>     iv)  pass  such  other  order or  direction which<br \/>\n         this Hon&#8217;ble Court may deem fit and proper<br \/>\n         to grant in the circumstances of the case&#8221;<\/p><\/blockquote>\n<p>    3.   The   learned   counsel   for   the   petitioner<\/p>\n<p>submitted that for the time being, it would be<\/p>\n<p><span class=\"hidden_text\">W.P.(C).No.31330 OF 2010    3<\/span><\/p>\n<p>sufficient, if the Assistant Educational Officer is<\/p>\n<p>directed     to    consider   Ext.P7   representation<\/p>\n<p>submitted by the petitioner, after affording an<\/p>\n<p>opportunity of being heard to the petitioner, the<\/p>\n<p>Manager and the 4th respondent.\n<\/p>\n<\/p>\n<p>    4. In the facts and circumstances of the case,<\/p>\n<p>the Writ Petition is disposed of directing the<\/p>\n<p>Assistant    Educational    Officer,  Kunnamkulam  to<\/p>\n<p>consider and dispose of Ext.P7 representation dated<\/p>\n<p>24.9.2010     submitted    by   the   petitioner   as<\/p>\n<p>expeditiously as possible, and at any rate within a<\/p>\n<p>period of six weeks from the date of receipt of a<\/p>\n<p>copy    of   the    judgment,   after  affording   an<\/p>\n<p>opportunity of being heard to the petitioner, the<\/p>\n<p>Manager and the 4th respondent.
