ANJANA PRAKASH\n                  ORAL ORDER<\/pre>\n<p>5\/   23-04-2012                   Heard the parties.\n<\/p>\n<p>                                  The petitioners seek quashing of the order dated<br \/>\n                  13.01.2009 passed by the Chief Judicial Magistrate, Aurangabad,<br \/>\n                  in Deo P.S. Case No.52 of 2008, by which cognizance has been<br \/>\n                  taken under sections 379, 420, 427, 461, 504, 323, 147, 149 Indian<br \/>\n                  Penal Code.\n<\/p>\n<p><span class=\"hidden_text\"> 2   Patna High Court Cr.Misc. No.10264 of 2009 (5) dt.23-04-2012<\/span><\/p>\n<p><span class=\"hidden_text\">                                             2\/3<\/span><\/p>\n<p>                              The case of the complainant is that his father had<br \/>\n             derived certain piece of land on the basis of a gift in the year 1948<br \/>\n             and 1952 but he learnt that the accused persons were in the<br \/>\n             process of executing sale deeds by misappropriating the said land.<br \/>\n             He tried to reason with the accused persons along with some<br \/>\n             witnesses but they refused to listen to the complainant. He then<br \/>\n             sent information to his brothers to bring the land documents and<br \/>\n             money on an appointed day at the Registry Office. When the<br \/>\n             complainant&#8217;s brother arrived along with the document and<br \/>\n             money, once again they tried to impress upon the accused persons<br \/>\n             not to execute the sale deed but they were adamant despite they<br \/>\n             having been shown the valid documents by the complainant. In<br \/>\n             course of discussion, the accused persons allegedly snatched the<br \/>\n             documents and tore up the same and also committed theft of<br \/>\n             money that had been brought by the Complainant&#8217;s brother.\n<\/p>\n<p>                              The investigation of the case proceeded at the end of<br \/>\n             which final report was submitted since during investigation it<br \/>\n             transpired that the accused persons were not transacting the land<br \/>\n             which had been derived on the basis of the gift deed. Disagreeing<br \/>\n             with the same, the Magistrate took cognizance in the matter.\n<\/p>\n<p>                              It has been submitted on behalf of the petitioners that<br \/>\n             the parties are agnates and the present case has been instituted by<br \/>\n             the Complainant to cause obstruction to the assertion of the<br \/>\n             petitioners&#8217; right over the land legally possessed by them. Further<br \/>\n             submission is that during investigation the police had found the<br \/>\n             allegation of theft and snatching of document false and, therefore,<br \/>\n             there is no justification for proceeding with the present complaint.\n<\/p>\n<p>                              On the other hand, counsel for the complainant<br \/>\n             submits that the accused persons have committed a wrong in<br \/>\n<span class=\"hidden_text\"> 3          Patna High Court Cr.Misc. No.10264 of 2009 (5) dt.23-04-2012<\/span><\/p>\n<p><span class=\"hidden_text\">                                                    3\/3<\/span><\/p>\n<p>                    executing the sale deed of land legally derived by him.\n<\/p>\n<p>                                     On going through the complaint, I find that there is<br \/>\n                    no allegation that the petitioners, in fact, had executed any sale<br \/>\n                    deed even though during investigation the police had found that<br \/>\n                    the accused persons had executed the sale deed, but of land which<br \/>\n                    had belonged to them. Evidently, the complaint is based on a civil<br \/>\n                    dispute giving rise to certain acts of theft and assault having been<br \/>\n                    committed which appears improbable in the background facts of<br \/>\n                    the case.\n<\/p>\n<p>                                     In my view, the present complaint has been filed to<br \/>\n                    settle a score which should have been determined by a Civil Court<br \/>\n                    of competent jurisdiction.\n<\/p>\n<p>                                     Hence, the entire proceeding including the order<br \/>\n                    dated 13.01.2009, passed by the Chief Judicial Magistrate,<br \/>\n                    Aurangabad, in Deo P.S.
