No.13072\/2010<\/a>\n01.10.2010\n\n      Shri Shamim Ahmed Khan, learned counsel for the\n\npetitioner.\n\n      Shri    Abhishek      Agrawal   learned       counsel   for   the\n\nrespondent Bank.<\/pre>\n<p>      Heard on the question of admission and interim relief.<\/p>\n<p>      The petitioner has filed this petition being aggrieved by<\/p>\n<p>the action taken by the respondents under the provisions of<\/p>\n<p>the   Securitization and Reconstruction of Financial Assets and<\/p>\n<p>Enforcement of Security Interest Act, 2002, pursuant to which a<\/p>\n<p>notice for taking possession has been issued to the petitioner on<\/p>\n<p>31.8.2010.\n<\/p>\n<p>      It is submitted by the learned counsel for the petitioner that<\/p>\n<p>the petitioner is willing to repay the loan provided the proposal<\/p>\n<p>submitted by the petitioner be considered and an amicable<\/p>\n<p>settlement be arrived at.\n<\/p>\n<p>      The learned counsel for the respondent Bank has objected<\/p>\n<p>to the prayer made by the learned counsel for the petitioner and<\/p>\n<p>submits that the proper remedy of the petitioner is to approach the<\/p>\n<p>concerned authority for mitigating his grievance.<\/p>\n<p>      From a perusal of the record, it is clear that the petitioner<\/p>\n<p>has not filed any such proposal before the said authorities after<\/p>\n<p>31.8.2010.\n<\/p>\n<p><span class=\"hidden_text\">                                     2<\/span><\/p>\n<p>        <a href=\"\/doc\/141317\/\">M\/s Jainsons Enterprises vs. Union Bank of India &amp; Ano.<\/p>\n<p>        In the<\/a> circumstances, without entering into the merits of the<\/p>\n<p>case, the petition filed by the petitioner is disposed of with liberty to<\/p>\n<p>the petitioner to approach the respondent authorities by making a<\/p>\n<p>proposal for repayment of loan and in case the petitioner does so,<\/p>\n<p>the authorities of the Bank shall consider the same keeping in mind<\/p>\n<p>the facts of the case and thereafter take a decision thereon after<\/p>\n<p>giving an opportunity of negotiating to the petitioner.<\/p>\n<p>        With the aforesaid observation the petition, filed by the<\/p>\n<p>petitioner, stands disposed of.\n<\/p>\n<p>        C.C as per rules.\n<\/p>\n<p>                                                   ( R.
