RAMACHANDRA MENON, J.\n              - - - - - - - - - - - - - - - - - - - - - - - - - -\n                      W.P.(C)No. 26835 OF 2005\n              - - - - - - - - - - - - - - - - - - - - - - - - - -\n              Dated this the 3rd day of September, 2010\n\n                                JUDGMENT\n<\/pre>\n<p>     The petitioners have approached this Court with the<\/p>\n<p>following prayers:-\n<\/p>\n<blockquote><p>            &#8220;i) issue a writ of certiorari or any other appropriate writ,<\/p>\n<p>     order or direction, quashing Ext.P1 notice.<\/p>\n<\/blockquote>\n<blockquote><p>            ii)   issue a declaration and direction declaring and<\/p>\n<p>     directing that the provisions of Section 2(xxxv)(e) and Section<\/p>\n<p>     52 of the Kerala VAT Act and          similar and allied provisions,<\/p>\n<p>     implicating Railway as a Transporting Agency coming within the<\/p>\n<p>     purview of the said Act, and the Railway Station, Railway Parcel<\/p>\n<p>     Office and Railway Goods Yard as place of business of the dealer<\/p>\n<p>     concerned under the Act, are unconstitutional, ultra vires the<\/p>\n<p>     Constitution and quashing the same, duly treating it as non-est<\/p>\n<p>     and non-existing.\n<\/p><\/blockquote>\n<blockquote><p>            iii) issue a writ of prohibition or any other appropriate<\/p>\n<p>     writ, order or direction, prohibiting the respondents from<\/p>\n<p>     proceeding against the Railway and Railway employees under<\/p>\n<p>     them by invoking provisions under the Kerala Vat Act.&#8221;<\/p>\n<\/blockquote>\n<blockquote><p>            2. The learned counsel for the petitioner submits that<\/p>\n<p>the impugned proceedings are initiated and pursued by the<\/p>\n<p>respondents on the basis of a judgment passed by this Court in<\/p>\n<p>OP No.18234 of 1999. The learned counsel further submits that<\/p>\n<p>WP(C) No. 26835 of 2005<\/p>\n<p><span class=\"hidden_text\">                                 -:2:-<\/span><\/p>\n<p>the verdict passed by the learned Single Judge has already been<\/p>\n<p>set aside by a Division Bench of this Court vide judgment in WA<\/p>\n<p>No.1715 of 2005, which is conceded by the learned Government<\/p>\n<p>Pleader as well.<\/p><\/blockquote>\n<p>           3. In the above circumstances, the Writ Petition is<\/p>\n<p>allowed in terms of the verdict passed in WA No.1715 of 2005.<\/p>\n<p>No costs.\n<\/p>\n<p>           It is made clear that the challenge against the<\/p>\n<p>constitutional validity of the provision is not dealt with or decided<\/p>\n<p>in this case.\n<\/p>\n<\/p>\n<p>                            P.R.
