ANAND, B.N.KIRPAL, V.N.KHARE\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>Order<br \/>\nWith  a\t view  to  tackle  problems  arising  out of<br \/>\nchaotic traffic conditions and vehicular pollution  and\t not<br \/>\nbeing  satisfied  with\tthe  steps  taken  by  the concerned<br \/>\nauthorities in addressing themselves to those problems, this<br \/>\nCourt issued certain  directions  accepting  the  report  of<br \/>\nBhure  Lal  Committee,\tas it was felt by the Court that any<br \/>\nfurther\t delay\tin  the\t performance  of  its  duty  by\t the<br \/>\nAdministration could  not  be  permitted.  At this stage, we<br \/>\nare concerned only with the direction issued by\t this  Court<br \/>\nto  the\t effect\t that all commercial vehicles which are more<br \/>\nthan 15 years old shall not  be\t permitted  to\tply  in\t the<br \/>\nNational  Capital  Territory  of  Delhi with effect from 2nd<br \/>\nOct.  1998.\n<\/p>\n<p>An affidavit has been filed by Shri S.\tRaghunathan,<br \/>\nPrincipal Secretary-cum-Commissioner  Transport,  Government<br \/>\nof National Capital Territory of Delhi on 28th August, 1998.<br \/>\nThe    learned\t Solicitor   General   appearing   for\t the<br \/>\nAdministration submits that  phasing  out  and\tbanning\t all<br \/>\ncommercial vehicles which are more than 15 years old by Oct.<br \/>\n2,  1998 would lead to great hardship to the owners of those<br \/>\nvehicles in particular and to the general public which makes<br \/>\nuse of\tthose  vehicles\t in  general.\t It  is,  therefore,<br \/>\nsubmitted  by  him that we may relax the rigour of the order<br \/>\nregarding  banning  of\t15  years  old\tcommercial\/transport<br \/>\nvehicles with  effect from 2nd Oct.  1998 and he assures the<br \/>\nCourt that the Administration itself is keen  to  phase\t out<br \/>\nall  such  vehicles gradually to case the pollution level in<br \/>\nthe city.  It is submitted that the ban order may be applied<br \/>\nin phases.\n<\/p>\n<p>A chart has been  filed\t by  the  learned  Solicitor<br \/>\nGeneral\t giving\t a  break  up  of the count of the number of<br \/>\ncommercial\/transport  vehicles\twhich  have  paid  road\t tax<br \/>\natleast once  after  1st April, 1997 yearwise.\tAccording to<br \/>\nthat chart we find that the number  of\tcommercial\/transport<br \/>\nvehicles are:-\n<\/p>\n<p>a)More than 25 years old. 5,718\n<\/p>\n<p>b)Between 24 and 25 years old\t954\n<\/p>\n<p>c)Between 23 and 24 years old\t635\n<\/p>\n<p>\td)Between 22 and 23 years old\t 524\n<\/p>\n<p>e)Between 21 and 22 years old\t748\n<\/p>\n<p>f)Between 20 and 21 years old\t770<br \/>\nThus, the total number of vehicles  which  are\tmore<br \/>\nthan 20\t years\told  are  9,349.    These  vehicles  are all<br \/>\ncommerciann vehicles which have been registered and on which<br \/>\nroad tax has been paid.\n<\/p>\n<p>The count of vehicles which are more than  15  years<br \/>\nbut less than 20 years old are :-\n<\/p>\n<p>a)Between 17 to 19 years3,200\n<\/p>\n<p>b)Between 15 to 16 years4,962<br \/>\nTo  mitigate the hardship, as pointed out by learned<br \/>\nSolicitor General and taking note of the assurance given  by<br \/>\nhim, we modify our previous order and direct that:\n<\/p>\n<p>a)  all commercial\/transport vehicles which are more<br \/>\nthan 20 years old  (9,349)  shall  be  phased  out  and\t not<br \/>\npermitted  to  ply  in\tthe National Capital Territory Delhi<br \/>\nafter 2nd October, 1998;\n<\/p>\n<p>b)  all such commercial\/transport vehicles which are<br \/>\n17 to 19 years old (3,200) shall not  be  permitted  to\t ply<br \/>\nafter 15th November, 1998;\n<\/p>\n<p>c)   such of the commercial\/transport vehicles which<br \/>\nare 15 years and 16 years old (4,962) shall not be permitted<br \/>\nto ply after 31st December, 1998.\n<\/p>\n<p>This order shall apply to  all\tcommercial\/transport<br \/>\nvehicles   whether   registered\t  in  the  National  Capital<br \/>\nTerritory of Delhi or outside (but ply in Delhi)  which\t are<br \/>\nof more than the stipulated age.\n<\/p>\n<p>This  ban order shall also be applicable to all such<br \/>\nvehicles which do not have any authority or permit to ply in<br \/>\nthe National Capital Territory of Delhi.<br \/>\nApart from the commercial\/transport  vehicles  which<br \/>\nare registered, as noticed above, we are informed that there<br \/>\nare  vehicles  which  are  either not registered or no which<br \/>\nroad tax has not been paid in National Capital Territory  of<br \/>\nDelhi. We direct that all such commercial\/transport vehicles<br \/>\nwhich  are  being  plied  without  payment  of\troad  tax or<br \/>\nregistration, shall not be allowed to ply  in  the  National<br \/>\nCapital Territory forthwith and in any event not with effect<br \/>\nfrom 2nd Oct. 1998.\n<\/p>\n<p>The   Motor  Vehicles  Department  and\tthe  Traffic<br \/>\nDepartment of Delhi Polic shall coordinate their efforts  to<br \/>\ncarry out these directions faithfully and punctually.<br \/>\nWe  further  direct that an affidavit shall be filed<br \/>\nby the Chief Secretary, Delhi Administration, undertaking to<br \/>\nensure that the directions hereinabove given are carried out<br \/>\nin letter and in spirit. The affidavit shall be filed during<br \/>\nthe course of this week.\n<\/p>\n<p>The  Transport Department and the Traffic Department<br \/>\nof the Delhi Police shall submit reports of  due  compliance<br \/>\nin  the\t first\tweek of October, 1998; 3rd week of November,<br \/>\n1998, and 1st week of January, 1999 with an advance copy  to<br \/>\nthe learned Amicus Curiae.\n<\/p>\n<p>List  the  matter  in  October, 1998 on a date to be<br \/>\nfixed by the registry after consultation  with\tthe  learned<br \/>\namicus curiae.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India M.C.
