\tPresent
\napplication is filed by the applicant ?  org. accused under Section
\n482 of the Code of Criminal Procedure to quash and set aside the
\ncomplaint being FIR II-105 of 2008 filed at Padra Police Station,
\nVadodara Rural, Dist; Vadodara dated 07\/09\/2008 for the offences
\npunishable under Sections  3, 5 and 6 of the Child Marriage Restraint
\nAct, 1929 (herein after referred to as ‘the Act’).\n<\/p>\n
2.\tA
\ncomplaint has been lodged with Padra Police Station, Vadodara Rural
\non 07\/09\/2008 against the applicant-org. Accused for the offence
\npunishable under Sections 3, 5 and 6 of the Act, alleging inter-alia
\nthat though the age of the applicant ?  org. accused No.1 was less
\nthan 21 years at the relevant time when he married with daughter of
\none ?  Ashishbhai still the applicant married and even the said
\nmarriage was registered before the Registrar of Marriages, Karkhadi,
\nTal. Padra, Dist: Vadodara under the provisions of the Gujarat
\nRegistration Marriages Act, 2006 and therefore it is alleged that at
\nthe relevant time when the applicant married, he was less than 21
\nyears and therefore the said complaint came to be filed by the
\nconcerned Police Officer of Padra Police Station.  Hence, the
\napplicant-org. Accused has preferred the present application for
\nquashing and setting aside the said complaint.\n<\/p>\n
3.\t\tShri
\nK.K.Pandey, learned Advocate appearing for the applicant-org. Accused
\nNo.1 has made following submissions to raise the following
\ncontentions in support of his prayer to quash and set aside the
\nimpugned complaint.\n<\/p>\n
\t\t\tThat
\n\t\t\tthe complaint has been filed with a mala-fide intention and only
\n\t\t\tto harass the applicant, as the marriage of the applicant with his
\n\t\t\twife ?  Shruti has not been liked by his in-laws.\n<\/p>\n
\t\t\tThe
\n\t\t\tcomplaint has been filed for the offences punishable under
\n\t\t\tSections 3, 5 and 6 of the Act.  However, in view of Section 21 of
\n\t\t\tthe Prohibition of Child Marriage Act, 2006, the Child Marriage
\n\t\t\tRetrain Act, 1929 is repealed.\n<\/p>\n
\t\t\tThe
\n\t\t\tmarriage of the applicant with Shruti was registered with the
\n\t\t\tRegistrar of Marriages under the Gujarat Marriages Registration
\n\t\t\tAct and therefore it cannot be said that the applicant has
\n\t\t\tcommitted any offence as alleged.\n<\/p>\n
\t\t\tTo
\n\t\t\tcontinue the proceedings by way of aforesaid complaint, is abuse
\n\t\t\tof process of law.\n<\/p>\n
4.\t\tMaking
\nabove submissions, it is requested to allow the present application
\nand to quash and set aside the FIR being lodged with Padra Police
\nStation, Vadodara Rural, Dist; Vadodara.\n<\/p>\n
5.\t\tShri
\nMaulik Nanavati, learned APP while opposing the application has
\nsubmitted that the questions of mala-fides are not required to be
\nconsidered at this stage and what is required to be considered is the
\nallegation and the averments in the complaint and whether it
\ndiscloses any cognizable offences or not, which requires further
\ninvestigation.  It is also further submitted that by him that on bare
\nreading of the complaint and the allegations and the submissions, the
\ncognizable offence is made out which requires further investigation
\nand whether the applicant had completed the age of 21 years, is the
\nquestion which is required to be considered at the time of trial on
\nleading proper evidence.  It is further submitted that even
\nconsidering Section 1 of the Prohibition of Child Marriage Act, 2006,
\nthe same shall come into force on such date, as the Central
\nGovernment may, by notification in the official gazette, appoint; and
\ndifferent dates may be appointed for different States and any
\nreference in any provision to the commencement of this Act shall be
\nconstrued in relation to any State as a reference to the coming into
\nforce of that provision in that State.\n<\/p>\n
6.\t\tIt
\nis submitted that applicant has not come out with specific
\nNotification by the State of Gujarat, as contemplated under Section 1
\n(3) of the aforesaid Act and in absence of the said, it cannot be
\nsaid that the Prohibition of the Child Marriage Act, 2006 is adopted
\nand further notified by the State Government.  It is, therefore,
\nrequested to dismiss the present application.\n<\/p>\n
7.\t\tHaving
\nheard learned Advocates for respective parties and on bare reading of
\nthe complaint and considering the averments and allegations in the
\ncomplaint, it prima-facie discloses cognizable offence which requires
\nfurther investigation.  Applicant has not produced any documentary
\nevidence in support of his submission that at the relevant time, he
\nhad already completed 21 years of age; whether the applicant ?  org.
\naccused No.1 had completed 21 years of age or not is a question which
\nrequires to be considered at the time of trial on leading proper
\nevidence.\n<\/p>\n
8.\t\tThe
\nquestion of mala-fides as alleged by the applicant are not required
\nto be considered at this stage and what is relevant is the act
\nalleged in the complaint and the allegation and submission in the
\ncomplaint. Under the circumstances, impugned complaint is not
\nrequired to be quashed and set aside by this Court in exercise of
\npowers under Section 482 of the Code of Criminal Procedure.\n<\/p>\n
9.\t\tNow
\nso far as the contentions on behalf of the applicant that in view of
\nSection 21 of the Prohibition of Child marriage Act, 2006, the Child
\nMarriage Restraint Act, 1929 is repealed in concern, considering the
\nprovision of Section 1 of the Prohibition of the Child Marriage Act,
\n2006,  the said Act shall come into force on such date, as the
\nCentral Government may, by notification in the official gazette,
\nappoint; and different dates may be appointed for different States
\nand any reference in any provision to the commencement of this Act
\nshall be construed in relation to any State as a reference to the
\ncoming into force of that provision in that State.  However, the
\napplicant has not produced any material to point out whether any
\nNotification has been issued \/ published by the State Government
\nappointing a particular date from which the State Act would come into
\nforce.  Hence, in absence of any material the prayer for the
\napplicant to quash the complaint on aforesaid ground cannot be
\ngranted.\n<\/p>\n
10.\t\tConsidering
\nthe above and for the reasons stated above, no case is made out to
\nquash the complaint \/ FIR in exercise of powers under Section 482 of
\nthe CRPC.  Hence the application deserves to be and is accordingly
\ndismissed.\n<\/p>\n
