CIVIL SURGEON-CUM-CHIEF MEDICAL OFFICER\n                ARARIA\n                                       -----------\n<\/pre>\n<p>2   03\/12\/2010           Annexure-28 dated 6.7.2009 is the impugned<\/p>\n<p>                order by virtue of which petitioner has been dismissed<\/p>\n<p>                from service. Primary allegation against the petitioner is<\/p>\n<p>                that he had been absent for more than five years without<\/p>\n<p>                any authority or authorization. Necessary chargesheet<\/p>\n<p>                has been annexed as annexure-20 to the writ application.<\/p>\n<p>                        Limited and pointed submission which has been<\/p>\n<p>                made by learned counsel for the petitioner is that<\/p>\n<p>                annexure-24 is supposed to be the enquiry report based<\/p>\n<p>                on which impugned order of punishment has been<\/p>\n<p>                passed. Annexure-24 is an abstract of the file or the<\/p>\n<p>                proceeding where the Court does not find any discussion<br \/>\n<span class=\"hidden_text\">                           -2-<\/span><\/p>\n<p>        as to the kind of evidence which was produced, the kind<\/p>\n<p>        of witnesses who were examined in support or any<\/p>\n<p>        explanation offered by the petitioner was considered.<\/p>\n<p>        The Enquiry Officer has simply recorded that the<\/p>\n<p>        petitioner had handed over charge to Dr. Captain D. N. P.<\/p>\n<p>        Sinha in 1997 and went on leave till 2002. Therefore, the<\/p>\n<p>        charge is proved and he recommended dismissal of the<\/p>\n<p>        petitioner from service.\n<\/p>\n<p>                 To say the least, the enquiry report is not only<\/p>\n<p>        perfunctory but also a mockery of an enquiry. Such<\/p>\n<p>        enquiry report can never form basis for imposition of<\/p>\n<p>        punishment like dismissal which is the ultimate<\/p>\n<p>        punishment in terms of harshness which can come to<\/p>\n<p>        visit an employee.\n<\/p>\n<p>                 Order of dismissal contained in annexure-28 is<\/p>\n<p>        hereby     quashed. Matter is remitted back to the<\/p>\n<p>        authorities to appoint a fresh Enquiry Officer who will<\/p>\n<p>        conduct enquiry in accordance with law and the Rules<\/p>\n<p>        extensively laid down in the C.C.A.
