This appeal is directed judgment and
\ndecree dated  passed by the
\nCivil Judge[S1′:’Dn;}:at  d  <\/p>\n
2;:   _  the plaintiff and
\nrespondents’ are before the trial Court.<\/p>\n
in  judg1een’t,'” for convenience, the parties are<\/p>\n
 referred their status before the trial Court.<\/p>\n
  pfpl\u00e9iaintiff contends that he is the owner in<\/p>\n
 “possession and enjoyment of 3 acres of land in Survey<\/p>\n
   of Maski Village, which is more fully described<\/p>\n
‘  …_’jiI1__’othe plaint schedule. Since the defendants tried to<\/p>\n
am<\/p>\n
interfere with plaintiffs possession of the suit schedule
\nproperty claiming a pathway on the northern side of the<\/p>\n
plaint schedule property. He filed O.S.No.I33\/V.<\/p>\n
decree of perpetual injunction. The defendarits”erit.e_red _<\/p>\n
appearance before the trial Qourt,  V <\/p>\n

schedule property bearing” No.3″   the <\/p>\n
defendants’ property _’nearing__l:lflissa_v No.4\u00abare part and
\nparcel of entire  :the same was
\nbelonging to B_til},a farriilyfl  in the Bulla
\nfamily, Hissavin had fallen to the
\nshare ‘er  and Hissa No.4 in Survey<\/p>\n
No.240   share of Basappa Bulla.\n<\/p>\n
 plEV’_.’V’i’1:i.'[iEff_:. p1_1rch’a’sed__.l~lissa No.3 in the year 1993 and<\/p>\n
 ‘def”enpdants”p:urchased Hissa No.4 in the year 1971. The<\/p>\n
 further contended that they are using the<\/p>\n
pathway; on the northern side of the plaint schedule<\/p>\n
 as ingress and egress to their property for<\/p>\n
  \u00e9fgricultural operation. On these grounds, the<\/p>\n
O}’\\}\\J*<\/p>\n
defendants opposed the claim of the plaintiff. On the
\nbasis of the pleadings, the trial Court framedtllthe<\/p>\n
following six issues for its consideration:-<\/p>\n

Court after hearing arguments  j;th..e <\/p>\n
appreciation of the pleadings, oral and dciciimentary <\/p>\n
evidence on record decreed  of vide
\njudgment dated    judgment
\nof the trial Cou_1″t, the appeal in
\nR.A.No.30\/_QV8..:V   appellate Court.

6. It is not in dispute that plaintiff is the owner
\nin possession of plaint schedule property. Further, it is<\/p>\n
not in dispute that on the western side of plaint<\/p>\n
schedule property, the defendants’ property is <\/p>\n
It is not in dispute that plaint schedule  <\/p>\n
defendants’ property are i-Iissa <\/p>\n
the entire Survey No.240. _ it  <\/p>\n
defendants that I-lissa No.3  to V<\/p>\n
one Chennappa Bul1.ai_…\u00a2_4′   of v”Cl’iennappa
\nBulla by name Basappa  Bulla<\/p>\n
got partitione’d’th”e land   In this<\/p>\n
partition, ‘ ‘S ‘ got Hissa No.4 and<\/p>\n
Siddalingappa.Elul_1a*._got”~~’i’Hissa No.3 in Survey No.240.<\/p>\n
  it  t’ne.\u00ab case of defendants that they<\/p>\n
 p’p?tirchpa’sed;’ii:i:ssa No.4 from the legal representatives of<\/p>\n
Eiasappaf and plaintiff purchased Hissa No.3 from<\/p>\n
l’.._Sinddalingappa Bulla. P.W.1 in his evidence admits<\/p>\n
   father has purchased plaint schedule property<\/p>\n
  healing Hissa No.3 in Survey No.2\/-10 from the son of<\/p>\n
\ufb01vv<\/p>\n
Siddalingappa Bulla. This admitted evidence on record<\/p>\n
clearly establishes the fact that the property of plaintiff<\/p>\n
and property of defendants were part and_:’_:parce–l _<\/p>\n
Survey No.240. It further establishes the in it ‘* <\/p>\n
partition among the predecessorsgin ftitle <\/p>\n
and defendants, the land to: be <\/p>\n
divided as Hissa No.3 and   there is a
\npartition in respect Of–_i1’l a particular
\nsurvey number; __the;1″ the Indian
\nEasementalfy’  at this
\nstage   (b) of Section 13 of<\/p>\n
The Indian”   S82 and they are as under:~<\/p>\n
  _s’ellsl’BTa \ufb01eld then used for<\/p>\n
 a.ag\ufb01–c;u1tura1 “” “purposes only. It is<\/p>\n
  _ ” except by passing over A’s<\/p>\n
by land or by trespassing on the<\/p>\n
 of a stranger. B is entitled to a<\/p>\n
ll  of way, for agricultural purposes<\/p>\n
only, over A’s adjoining land to the \ufb01eld
\nsold.\n<\/p>\n

(b) A, the owner of two fields, sells
\none to B, and retains the other. The
\nfield retained was, at the date of the _
\nsale, used for agricultural purposes
\nonly, and is inaccessible except
\npassing over the \ufb01led sold to B.\n<\/p>\n

Hissa l.’T4*i1i:ifSui*if%e:,r ll’\\l():I\u00a7’.4:(}l.._lll’I\\\u00a7lC\ufb02}W by virtue of division<\/p>\n
of I-Iissla No.3 No.4 in Survey No.240, the<\/p>\n
land in poslsessiori oi”‘v_defendants in Hissa No.4 is on the<\/p>\n
 “v.weste’rz%1′-aside’ of  schedule property. Therefore, the<\/p>\n
  arellfiaving easemeritary right by necessity to<\/p>\n
reach  through the plaint schedule property as<\/p>\n
 illustration (a) and illustration (‘0) to Section 13 of<\/p>\n
A   E-Eiseixientaly Act.\n<\/p>\n

8. The piaintiff contends that there is an<\/p>\n
alternative road having access to the defendants’V–“1and<\/p>\n
and therefore, there is no necessity for the  V.<\/p>\n
claim right of Way in the plajnt schedu1e__ppropertVy.”d T’  <\/p>\n
decline to accept this contentionof iearriedi <\/p>\n

The lower appellate Court by properly appreciating this
\nposition of law and the facts involved in the case rightly
\nconcluded that plaintiff is not entitled for perpetual<\/p>\n
injunction as prayed for.\n<\/p>\n
9. The learned counsel for the plaintiff C’<\/p>\n
on a judgment of this Court reported<\/p>\n

Easeme:’ntar’y Act. Therefore, the reasoning of the lower<\/p>\n
it Iilippellate Court is in accordance with the law declared<\/p>\n

10. The learned counsel for the plaintiff<\/p>\n
contends that the defendants in their written sta.te1nent<\/p>\n
have not made any counter claim and  .<\/p>\n
lower appellate Court ought to have i”efrained=: f1’OI13.i “‘<\/p>\n
giving a finding that defendants ii’haiIirig:”:<\/p>\n
easement of necessity on the noprthefi-n sidefof =t’_h\u00abe..p1-aint r L’<\/p>\n
schedule property. I decline thisioontention of
\nthe learned counsel V   in a suit for
\nperpetual injunntion,   plaintiff is
\nnot in u  property, then

property, the defendants have no right to interfere-with<\/p>\n
plaintiffs possession and enjoyment of the  3<\/p>\n
land in the plaint schedule property.    <\/p>\n
