This application was placed<br \/>\nfor admission hearing before the Court on February 3, 2006 and after<br \/>\nconsidering the averments made therein, rule was issued making it<br \/>\nreturnable today. The learned A.P.P. was also requested to verify the<br \/>\ncorrectness of averments made in the application and produce before<br \/>\nthe Court on the returnable date the latest medical-certificate<br \/>\nindicating as to from which ailment the convict is suffering and<br \/>\nwhether he is responding to the treatment given to him. Today, during<br \/>\nthe course of hearing of the application, the learned A.P.P. has<br \/>\nproduced certificate dated February 6, 2006 issued by Dr.S.A.Arya,<br \/>\nMedical Officer, Vadodara Jail Dispensary, to the Superintendent,<br \/>\nVadodara Central Prison. It is ordered to be taken on record of the<br \/>\ncase. It reads as under :\n<\/p>\n<p>\t?SWith reference to above<br \/>\nsubject C.P.No.76964- Chhaganlal Pannalal is taking treatment from<br \/>\nJail Dispensary as well as from S.S.G.Hospital, Vadodara since last 2<br \/>\nto 3 years.\n<\/p>\n<p>\tHe is known case of ILA<br \/>\n(Interstilial Lung Diseases) with Right side Phenothorax and patient<br \/>\nis at present on conservative treatment in Jail Dispensary and<br \/>\nS.S.G.Hospital, Vadodara.\n<\/p>\n<p>\tHe is K\/C\/O Hbs Ag + ve<br \/>\ncase (Hepatitis B) with ? Post Koch&#8217;s Sequelae ? Bronchiectasis ?<br \/>\nMalignancy.\n<\/p>\n<p>\tAt present patient is<br \/>\ntaking conservative treatment from S.S.G.Hospital Vadodara and at<br \/>\npresent patient&#8217;s condition is stable with conservative treatment<br \/>\nfrom S.S.G.H.??\n<\/p>\n<p>3.\tIn view of contents of<br \/>\nabove-quoted certificate, this Court is of the opinion that the<br \/>\nconvict is being given conservative treatment from S.S.G.Hospital,<br \/>\nVadodara and at present his condition is stable. Therefore,  prayer<br \/>\nmade in the application cannot be granted and is liable to be<br \/>\nrefused, more particularly when the conviction recorded is for<br \/>\nserious offences punishable under the provisions of the N.D.P.S.Act.\n<\/p>\n<p>\t\t\tFor the foregoing reasons, the<br \/>\napplication fails and is rejected.
