SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 21\/02\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>\tA<br \/>\n\tgrievance which is voiced in the present petition is that despite<br \/>\n\tthe petitioner representing to the concerned respondents to initiate<br \/>\n\tappropriate action against the respondent No.5 under sec.37 of the<br \/>\n\tGujarat Municipalities Act, no further steps have been taken and<br \/>\n\trepresentation submitted by the petitioner has not been decided.\n<\/p>\n<p>\tIt<br \/>\n\tappears that the petitioner<br \/>\n\thas recently approached the Director of Municipalities to initiate<br \/>\n\tproceedings against the respondent No.5 under sec.37 of the Gujarat<br \/>\n\tMunicipalities Act i.e. on 10\/1\/2011. Sufficient time is required to<br \/>\n\tbe granted to the Director of Municipalities to look into the<br \/>\n\trepresentation made by the petitioner and  apply its mind and<br \/>\n\tthereafter to initiate proceedings under<br \/>\n\tsection  37 of the Gujarat Municipalities Act, if a<br \/>\n\tprima facie case is made out and the Director of Municipalities is<br \/>\n\tsatisfied that proceedings under sec.37 of the Gujarat<br \/>\n\tMunicipalities Act are required to be initiated against the<br \/>\n\trespondent No.5. Therefore, the present petition is not entertained<br \/>\n\tat this stage. However, it is expected that the Director of<br \/>\n\tMunicipalities shall look into the representation submitted by the<br \/>\n\tpetitioner dtd.10\/11\/2011<br \/>\n\tand  take appropriate decision on the same at the earliest.
