DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 09\/09\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>\tRule.\n<\/p>\n<p>Mrs. Krina Calla,  learned APP, waives service of notice of Rule for<br \/>\nrespondent &#8211; State.\n<\/p>\n<p>2.\tThis<br \/>\napplication is filed under Section 439 of the Code of Criminal<br \/>\nProcedure in connection with first information report registered at<br \/>\nCR No.II-3219 of 2010 with Surat Railway Police Station, District<br \/>\nSurat for the offences punishable under Sections 8(C), 20(B), 29 of<br \/>\nN.D.P.S.Act.\n<\/p>\n<p>3.\tLearned<br \/>\nadvocate appearing for the applicant-accused submitted that the<br \/>\napplicant is an innocent person and has not committed the alleged<br \/>\ncrime.  He further submitted that during the remand no other material<br \/>\nis recovered from the possession of the  petitioner.  He lastly<br \/>\nsubmitted that the charge sheet is already filed and the petitioner<br \/>\ndeserves to be enlarged on bail.\n<\/p>\n<p>4.\tMrs.\n<\/p>\n<p>Krina Calla, learned APP, appearing for the respondent-State<br \/>\nvehemently opposed grant of bail to the applicant.\n<\/p>\n<p>5.\tHaving<br \/>\nheard learned counsel for the parties and perusing the record of the<br \/>\ncase, prima facie it appears that the applicant-accused is involved<br \/>\nin the serious crime of smuggling contraband article. Even<br \/>\nconsidering the quantity of the contraband material, role attributed<br \/>\nto the applicant and involvement of the accused in the heinous crime<br \/>\nof smuggling contraband material, this court is of the opinion that<br \/>\nno case is made out to enlarge the applicant-accused on regular bail.\n<\/p>\n<p>\tAccordingly,<br \/>\nthis application stands dismissed.
