BALAKRISHNAN NAIR &amp; M.L.JOSEPH FRANCIS, JJ.\n                  ------------------------------------\n                   W.P.(C) No. 327 OF 2006\n                  -------------------------------------\n          Dated this the 13th day of February, 2009\n\n                         J U D G M E N T\n<\/pre>\n<p>                         ~~~~~~~~~~~<\/p>\n<p>Balakrishnan Nair, J.\n<\/p>\n<\/p>\n<p>      The respondents in O.A.No.126\/2005 before the Central<\/p>\n<p>Administrative Tribunal, Ernakulam Bench are the writ<\/p>\n<p>petitioners. The 1st respondent herein was the applicant. He<\/p>\n<p>filed Ext.P1 Original Application challenging his transfer from<\/p>\n<p>Kannur to Meerut, under Annexure-A2 order, and also other<\/p>\n<p>related orders. The C.A.T, after hearing both sides, allowed the<\/p>\n<p>Original Application as per Ext.P8 and the following directions<\/p>\n<p>were issued.\n<\/p>\n<p>           &#8220;10. In    the    conspectus     of   facts  and<br \/>\n           circumstances I am of the considered view<br \/>\n           that the transfer of the applicant is not in<br \/>\n           the  true    spirit   of   the   guidelines  and<br \/>\n           therefore      Annexure-A2,        Annexure-A7,<br \/>\n           Annexure-A9 and Annexure-A10 impugned<br \/>\n           orders will not stand in its legs. The same are<br \/>\n           set aside. Respondents are directed to grant<br \/>\n           proper reliefs to the applicant by retaining<br \/>\n           him at Kannur since he is entitled for the<br \/>\n           same as per the guidelines.&#8221;\n<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.327\/2006            2<\/span><\/p>\n<p>Challenging Ext.P8, this writ petition was filed. This Court did<\/p>\n<p>not grant any interim order, therefore, the 1st respondent<\/p>\n<p>continued at Kannur. The vacancy in Meerut, to which the 1st<\/p>\n<p>respondent was transferred, must have been filled up long ago.<\/p>\n<p>The said respondent has now passed 58 years of age. In view of<\/p>\n<p>the above position, the orders impugned in the Original<\/p>\n<p>Application cannot be implemented now. But, we feel that the<\/p>\n<p>power of the appointing authority to transfer the 1st respondent<\/p>\n<p>in future in accordance with the relevant norms or in exigencies<\/p>\n<p>of service should be upheld.
