M. SAHAI)<\/a><\/p>\n<p>1.\t\tBy<br \/>\nway of this Appeal, the appellant has challenged the judgment and<br \/>\norder dated 27.9.2010 passed by the learned Single Judge in Special<br \/>\nCivil Application No. 9146 of 1999.\n<\/p>\n<p>2.\t\tLearned<br \/>\ncounsel for the appellant has contended that the learned Single Judge<br \/>\nhas committed an error in not granting the prayer made by the<br \/>\npetitioner to grant pay scale which were granted to to the junior<br \/>\nemployees. Learned counsel for the appellant has shown the service<br \/>\nbook of juniors and also benefits conferred to the juniors. However,<br \/>\nwhile considering the case of the petitioner,the learned Single Judge<br \/>\nhas observed that in view of the decision of the Apex Court in Union<br \/>\nof India and others v.M.K.Sarkar 2010(2)SCC 59, the<br \/>\npetitioner has not opted when juniors had opted for earlier scheme.<br \/>\nIn paragraphs 9 and 17 of the said judgment, the Apex Court has<br \/>\nobserved as under:\n<\/p>\n<p>&#8220;9. When a<br \/>\nscheme extending the benefit of option for switch over, stipulates<br \/>\nthat the benefit will be available only to those who exercise the<br \/>\noption within a specified time, the option should obviously be<br \/>\nexercised within such time. The option scheme made it clear that no<br \/>\noption could be exercised after the last date. In this case, the<br \/>\nrespondent chose not to exercise the option and continued to remain<br \/>\nunder the Contributory Provident Fund Scheme, and more importantly,<br \/>\nreceived the entire PF amount on his retirement.&#8221;\n<\/p>\n<p>17.  Even on<br \/>\nmerits, the application has to fail. In Krishena Kumar v.Union of<br \/>\nIndia a Constitution Bench of this Court considering the options<br \/>\ngiven to the railway employees to shift to pension scheme, held that<br \/>\nprescription of cut-off dates while giving each option was not<br \/>\narbitrary or lacking in nexus. This Court also held that provident<br \/>\nfund retirees who failed to exercise option within the time were not<br \/>\nentitled to be included in the pension scheme on any ground of<br \/>\nparity. Therefore, the respondent who did not exercise the option<br \/>\navailable when he retired in 1976, was not entitled to seek an<br \/>\nopportunity to exercise option to shift to the pension scheme, after<br \/>\nthe expiry of the validity period for option scheme, that too in the<br \/>\nyear 1998 after 22 years.&#8221;\n<\/p>\n<p>3.\t\tThe<br \/>\nprinciples laid down by the Apex Court will also apply to the facts<br \/>\nof the instant case. In that view of the matter, the view taken by<br \/>\nthe learned Single Judge is just and proper and more particularly in<br \/>\nview of the judgment of the Apex Court cited above. The Appeal is<br \/>\ndevoid of merits.
