Justice ANTONY DOMINIC\n\n Dated :07\/10\/2010\n\n O R D E R\n                   ANTONY DOMINIC, J.\n                    -----------------------------\n                 W.P.(C) No.31135 of 2009\n                 -----------------------------------\n          Dated this the 7th day of October 2010\n\n\n                       J U D G M E N T\n<\/pre>\n<p>     Amendment allowed.\n<\/p>\n<p>     Petitioner is a B.Tech student in the 4th respondent<\/p>\n<p>college. In this writ petition what is under challenge is<\/p>\n<p>Ext.P8.\n<\/p>\n<p>     2.   While undergoing the course in the 7th semester,<\/p>\n<p>petitioner had attendance shortage of 9 days from the<\/p>\n<p>minimum required 75%. He submitted Ext.P3 application<\/p>\n<p>for condonation enclosing Ext.P4 medical certificate.       In<\/p>\n<p>this writ petition, what he initially sought was a direction to<\/p>\n<p>consider his application. The application is now rejected by<\/p>\n<p>Ext.P8 order and the reason stated is that the candidate<\/p>\n<p>had already availed condonation twice during the course<\/p>\n<p>and therefore, no more condonation is permissible.<\/p>\n<p>W.P.(C) No.31135 of 2009<\/p>\n<p><span class=\"hidden_text\">                              -: 2 :-<\/span><\/p>\n<p>     3.    In my view the reason stated in Ext.P8 is<\/p>\n<p>unassailable for the reason that the provisions of the<\/p>\n<p>Examination Manual framed by the University does not<\/p>\n<p>support the claim made by the petitioner. On the other<\/p>\n<p>hand, the provisions dealing with condonation of shortage<\/p>\n<p>of attendance incorporated in the Examination Manual<\/p>\n<p>framed     by   the    University    specifically  provide  that<\/p>\n<p>condonation of shortage of attendance shall not be granted<\/p>\n<p>for more than one academic year for any course of study or<\/p>\n<p>for shortage exceeding 20 days in an academic year. Thus,<\/p>\n<p>condonation can be claimed by student only once in his<\/p>\n<p>entire course. It is the admitted case of the petitioner that<\/p>\n<p>during the 3rd and 4th semester he has already availed the<\/p>\n<p>benefit    of  condonation     of    shortage    of  attendance.<\/p>\n<p>Therefore, it was impermissible for the petitioner to seek<\/p>\n<p>condonation once again during the course of study.<\/p>\n<p>     4.    It is the contention of the counsel for the<\/p>\n<p>petitioner that in the absence of any such restriction either<\/p>\n<p>W.P.(C) No.31135 of 2009<\/p>\n<p><span class=\"hidden_text\">                               -: 3 :-<\/span><\/p>\n<p>in   the   Kerala     University    Act or Ordinance, it  is<\/p>\n<p>impermissible for the respondents to decline condonation<\/p>\n<p>on the ground mentioned in the Examination Manual.<\/p>\n<p>However, as rightly pointed out by the learned Standing<\/p>\n<p>Counsel for the University, the First Ordinance of the<\/p>\n<p>University (Chapter VII therein) authorized the University<\/p>\n<p>to frame rules for the conduct of examination.         It is<\/p>\n<p>exercising such powers that the Syndicate has framed the<\/p>\n<p>Examination Manual which provides limitations on the<\/p>\n<p>power of the University to condone the shortage of<\/p>\n<p>attendance.       Therefore, by making provision in the<\/p>\n<p>Examination Manual the Syndicate has imposed restrictions<\/p>\n<p>on the extent upto which shortage of attendance can be<\/p>\n<p>condoned. In that view of the matter, on merits, the claim<\/p>\n<p>of the petitioner has to be rejected and I do so.<\/p>\n<p>     5.    By virtue of the interim order passed by this<\/p>\n<p>Court, petitioner has undergone the course in the 8th<\/p>\n<p>semester and has also appeared the examinations.<\/p>\n<p>W.P.(C) No.31135 of 2009<\/p>\n<p><span class=\"hidden_text\">                              -: 4 :-<\/span><\/p>\n<p>Although I have negatived the claim of the petitioner for<\/p>\n<p>condonation of shortage of attendance for the 7th semester<\/p>\n<p>it is made clear that this Court did not deal with petitioner&#8217;s<\/p>\n<p>contention that is entitled to get credit for 8th semester<\/p>\n<p>course undergone and the examinations appeared by him.<\/p>\n<p>These are matters for the petitioner to claim before the<\/p>\n<p>appropriate authority.\n<\/p>\n<p>           Writ petition is disposed of as above.\n<\/p>\n<\/p>\n<p>                               ANTONY DOMINIC, JUDGE.\n<\/p>\n<p>Jvt<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Govind Vishnu A vs The University Of Kerala on 7 October, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 31135 of 2009(J) 1.
