If this First<br \/>\nAppeal is entertained, the entire object of Section 140 will stand<br \/>\nfrustrated.\n<\/p>\n<p>2.\tThe<br \/>\nlearned Advocate for the appellant   insurance company submitted<br \/>\nthat the insurance company has filed this appeal only to put on<br \/>\nrecord their protest against the order passed wherein the opponents<br \/>\nare jointly and severally held liable to pay amount of compensation<br \/>\nwith interest payable on it. He submitted that the claimants in Claim<br \/>\nCase No. 78 of 2007 are the heirs of the driver of the Maruti Van<br \/>\nbearing registration No. GJ-25-A-618, which was involved in an<br \/>\naccident, as he is responsible for the accident he is not entitled to<br \/>\nrecover any amount from the insurer of the motor vehicle, which he<br \/>\nwas driving.\n<\/p>\n<p>3.\tBe<br \/>\nthat as it may, it is clarified that it will be open for the<br \/>\ninsurance company to take all available contentions in the main claim<br \/>\npetition. With this observation, this First Appeal is dismissed.\n<\/p>\n<p> Order<br \/>\nin C.A. 7370 of 2010<\/p>\n<p>1.\tThe<br \/>\ncivil application is dismissed. The insurance company is directed to<br \/>\ndeposit the remaining amount on or before 16th August<br \/>\n2010, failing which, a serious note of the same will be taken.\n<\/p>\n<p>(RAVI<br \/>\nR.
