Justice S.S.SATHEESACHANDRAN\n\n Dated :10\/02\/2011\n\n O R D E R\n             THOTTATHIL B.RADHAKRISHNAN\n                                     &amp;\n                S.S.SATHEESACHANDRAN, JJ.\n                     -----------------------------------\n                    W.P(C).No.3778 OF 2011\n                     ------------------------------------\n            Dated this the 10th day of February, 2011\n\n\n                             JUDGMENT\n<\/pre>\n<p>Thottathil B.Radhakrishnan,J.\n<\/p>\n<\/p>\n<p>     Having regard to the nature of order being issued<\/p>\n<p>hereunder, notice to the 8th respondent dispensed with,<\/p>\n<p>preserving his right for re-hearing of the matter, if aggrieved.<\/p>\n<p>     Heard learned counsel for the petitioner and learned<\/p>\n<p>Government Pleader for respondents 1 to 7.<\/p>\n<p>     The petitioner is one among the parties to a civil suit<\/p>\n<p>pending before the Sub Court, Kozhikode. He says that, that is<\/p>\n<p>a suit for partition between him and siblings. The allegation in<\/p>\n<p>this writ petition is that the 8th respondent, who was granted<\/p>\n<p>some right to do mining activities, is carrying on such<\/p>\n<p>activities beyond the licence period and contrary to law in as<\/p>\n<p>WPC.3778\/11<\/p>\n<p><span class=\"hidden_text\">                               2<\/span><\/p>\n<p> much as, as of now, the 8th respondent does not have any<\/p>\n<p> permission.   This is an issue that the petitioner can press<\/p>\n<p> before the civil court in appropriate suit or present before the<\/p>\n<p> second respondent District Collector or the 4th respondent<\/p>\n<p> Geologist who are duty bound to ensure that there is no<\/p>\n<p> mining activity in the State of Kerala in the respective<\/p>\n<p> territories under their jurisdiction except in accordance with<\/p>\n<p> the     law governing     mining   activities.    Under    such<\/p>\n<p> circumstances, we order that any complaint pending before<\/p>\n<p> the 2nd or 4th respondent will gain attention and appropriate<\/p>\n<p> orders will be issued thereon within a period of three weeks<\/p>\n<p> from the date of receipt of a copy of this judgment.
