THE DISTRICT MAGISTRATE, MADHUBANI.\n                             -----------\n<\/pre>\n<p>02.   26.11.2010            Heard learned counsel for the petitioners<\/p>\n<p>                  and the State.\n<\/p>\n<p>                            The matter relates to grant of pay-scale of<\/p>\n<p>                  Rs.   4000-6000\/-       in   lieu   of    Rs.   3050-4590    in<\/p>\n<p>                  pursuance of the appointment after Advertisement No.<\/p>\n<p>                  1 of 2002. The petitioners were employed as Managers<\/p>\n<p>                  in the P.A.C.S. In pursuance of certain directions of<\/p>\n<p>                  the Court they came to be absorbed in service through<\/p>\n<p>                  Bihar Public Service Commission, under the aforesaid<\/p>\n<p>                  advertisement by a merit process.\n<\/p>\n<p>                            No further discussion of facts and Court&#8217;s<\/p>\n<p>                  orders are required in view of Annexure-A of the<\/p>\n<p>                  counter affidavit issued by the State Government in<\/p>\n<p>                  the Department of Co-operative.\n<\/p>\n<p>                            The    writ    petition    is   disposed   off   with<\/p>\n<p>                  directions to the concerned respondents, the District<\/p>\n<p>                  Magistrate or the Commissioner as the case may be to<\/p>\n<p>                  act strictly in accordance with directions of the<\/p>\n<p>                  Government, contained in paragraph-6 of the order<\/p>\n<p>                  dated 13.7.2010, at Annexure-A in its true letter and<\/p>\n<p>                  sprit. If any petitioners represent to the Chief Secretary<\/p>\n<p>                  of the State that any particular District Magistrate or<br \/>\n<span class=\"hidden_text\">                          3<\/span><\/p>\n<p>       Commissioner was not acting in accordance with the<\/p>\n<p>       true sprit of the instructions contained in paragraph-6<\/p>\n<p>       in all its aspects, the Court expects the Chief Secretary<\/p>\n<p>       to deal with the issues appropriately in accordance<\/p>\n<p>       with law both administrative and disciplinary.<\/p>\n<p>                 It is expected that once the Government has<\/p>\n<p>       issued necessary directions, those required to comply,<\/p>\n<p>       it shall do so forthwith for which the petitioners, if so<\/p>\n<p>       advised, may file a representation. Any writ application<\/p>\n<p>       hereinafter for enforcement of the Government order<\/p>\n<p>       may not find the appreciation of the Court insofar as<\/p>\n<p>       the respondents are concerned.\n<\/p>\n<p>                 The application stands disposed.\n<\/p>\n<\/p>\n<pre>P.K.
