DAVE\n\t\t\n\t\n\n \n\nDate\n: 09\/05\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>\tHeard<br \/>\nthe learned counsel for the parties,<\/p>\n<p>\tLearned<br \/>\ncounsel for the parties jointly submit that, as per the consent terms<br \/>\nrecorded on 6th May 2011 between the parties, namely, the<br \/>\nplaintiff, defendant No.1 and defendant No.3, the dispute is settled<br \/>\nout of the court in terms of  the consent terms signed by the parties<br \/>\nand their advocates respectively. It is further submitted that the<br \/>\ndemand draft of Rs.450 lakhs being No.440493 dated 26.4.2011 drawn in<br \/>\nfavour of Mundra Port issued by the Standard Chartered Bank, Mumbai,<br \/>\nis handed over to the learned counsel for the plaintiff in the Court<br \/>\ntoday when the matter is taken up for hearing.\n<\/p>\n<p>\tThe<br \/>\nconsent terms is ordered to be taken on record and shall form part of<br \/>\nthe order.\n<\/p>\n<p>\tIn<br \/>\nview of the above, no dispute remains between the parties and the<br \/>\nsuit is dismissed as settled out of the Court in terms of the consent<br \/>\nterms dated 6.5.2011. Notice is discharged. The interim relief stands<br \/>\nvacated. There shall no order as to costs.\n<\/p>\n<p>\tOJ<br \/>\nMisc.
