1.\tBy
\nway of this petition under Article 226 of the Constitution of India,
\nthe petitioner challenges the Government resolution dated 10th
\nMarch, 2001 as well as reply dated 18th December, 2007
\ngiven by the Government and seeks a declaration that the petitioner
\nis eligible and entitled to get a residential plot at concessional
\nrate in the light of the earlier policies as well as the Government
\nresolution dated 10th February, 1999.\n<\/p>\n
2.\tThe
\nfacts of the case stated briefly are that the State Government had
\nvide Government resolution dated 20th November, 1979
\nframed a policy for providing residential plots to employees in terms
\nof the conditions laid down therein. One of the conditions stipulated
\nwas that the application should be made on or before 31st
\nMarch, 1988. It is an admitted position that the petitioner had not
\nmade any application for allotment of the plot at concessional rate
\nat the relevant time. Subsequently, pursuant to representations made
\nby the Government employees, the Government came out with another
\nresolution dated 10th February, 1999, whereby the time
\nlimit for making applications for allotment of plots was extended to
\n31st May, 1999. Pursuant to the said resolution, the
\npetitioner made an application dated 30th April, 1999 for
\nallotment of plot at subsidized rate within the time frame stipulated
\nunder the said Government resolution. However, thereafter, no action
\nwas taken on the said application made by the petitioner.
\nSubsequently, the petitioner addressed a communication dated 23rd
\nNovember, 2007 to the Secretary, Roads and Buildings Department for
\nprocessing his application.\n<\/p>\n
3.\tVide
\ncommunication dated 18th December, 2007, the petitioner
\nwas informed that in view of the subsequent resolution dated 29th
\nMarch, 2001, all applications made pursuant to the resolution dated
\n10th February, 1999 had been treated as cancelled.\n<\/p>\n
4.\tBeing
\naggrieved, the petitioner has moved the present petition challenging
\nthe aforesaid Government resolution dated 29th March, 2001
\nas well as communication dated 18th December, 2007.\n<\/p>\n

\nMr. Pinakin M. Raval, learned advocate for the petitioner.\n<\/p>\n
6.\tIt
\nis submitted that the impugned Government resolution dated 29th
\nMarch, 2001, whereby applications made pursuant to the Government
\nresolution dated 10th February, 1999 have been cancelled,
\nis violative of petitioner’s fundamental right to shelter under
\nArticle 21 of the Constitution of India inasmuch as the petitioner is
\ndeprived of a shelter. It is submitted that in case of similarly
\nsituated persons, the Government has already allotted plots at
\nconcessional rates in the light of the Government Resolution dated
\n10th February, 1999. It is submitted that in the
\ncircumstances, on the ground of parity, the petitioner is entitled to
\nallotment of residential plot at a concessional rate.\n<\/p>\n

\nperusal of the averments made in the petition shows that except for a
\nbald averment that in identical cases, similarly situated persons
\nhave been allotted plots at concessional rates in the light of the
\nGovernment Resolution dated 10th February, 1999, no
\nspecific instances have been cited as to in which case, the
\nGovernment has in fact granted plots at concessional rates under the
\nsaid Government resolution.\n<\/p>\n
8.\tBesides,
\nby Government resolution dated 29th March, 2001, the
\nGovernment had vide the said resolution framed a new policy for
\nallotment of plots without auction for residential purposes at
\nGandhinagar to non-transferable employees at concessional rates and
\ntaken a policy decision to cancel the Government resolution dated
\n10th February, 1999 as well as all the applications made
\npursuant thereto.  The learned advocate for the petitioner is not in
\na position to show as to how the impugned Government resolution is
\ninvalid or not in consonance with the provisions of any law or is
\notherwise unconstitutional. In the circumstances, in absence of any
\nvalid grounds for challenging the said resolution, no case is made
\nout insofar as the challenge to the said resolution is concerned.\n<\/p>\n
9.\tAs
\nregards the contention that the petitioner is deprived of his right
\nto shelter under Article 21 of the Constitution, the same is
\nthoroughly misconceived inasmuch as allotment of plot on concessional
\nrates is an additional service benefit given to a Government servant.
\nIn our country, where there are thousands of homeless and unemployed
\npersons, a right to allotment of a plot at concessional rates to a
\nwell employed Government servant, certainly cannot be equated with
\nthe right to shelter as envisaged under Article 21 of the
\nConstitution.\n<\/p>\n
10.\tInsofar
\nas the challenge to the reply dated 18th December, 2007 is
\nconcerned, the same is merely based upon the Government resolution
\ndated 29th March, 2001, in the circumstances, no infirmity
\ncan be found in the decision of the Government.\n<\/p>\n
11.\tFor
\nthe foregoing reasons, the petition being devoid of merits, is
\nsummarily rejected.\n<\/p>\n
