Verma, Counsel for the applicants.\n      Ms. Neelam Goel, Counsel for the respondents.<\/pre>\n<p>      This order shall decide review petitions No.569 of 2010,<br \/>\nR.P. No.570 of 2010, R.P. No.571 of 2010 and R.P. No. 572 of<br \/>\n2010 in which      the applicants are seeking review of common<br \/>\norder dated 13.8.2010 passed in Civil Revision No.350\/09,<br \/>\nC.R.351\/09,      C.R.     No.   353\/09     and   C.R.   No.356\/10.    For<br \/>\nconvenience facts are taken from R.P. No.569 of 2010.\n<\/p>\n<p>      Learned counsel for the applicants submitted that the<br \/>\nDivision Bench was considering a reference made by a Single<br \/>\nBench of this Court on 26.3.2010 by which following question<br \/>\nwas referred:-\n<\/p>\n<blockquote><p>        &#8221;       Whether the view of the learned Single Bench<br \/>\n        of this Court in the matter of Mohan @ Munna<br \/>\n        Pachari (supra) that the period spent for obtaining<br \/>\n        certified copy of ex-parte decree cannot be excluded<br \/>\n        for calculating the limitation under Article 123 of the<br \/>\n        Limitation Act is the correct view or the earlier<br \/>\n        contract view of the Single Bench of this Court in the<br \/>\n        matter of Shakuntala Singh (supra) is correct?&#8221;<\/p><\/blockquote>\n<p>      The Division Bench has not considered the fact that in<br \/>\nShakuntala Singh (supra) in which period spent in obtaining<br \/>\ncertified copy was excluded and delay was condoned.                  It is<br \/>\nsubmitted that Shakuntala Singh&#8217;s case was based on a<br \/>\njudgment of the Privy Council in Jijibhoy N. Surty vs. T.S.<br \/>\nChettyar [AIR 1928 PC 103] and also of the Apex Court in The<br \/>\nAdditional Collector, Customs, Calcutta and another vs.<br \/>\nM\/s Best and Co. [AIR 1966 SC 1713].\n<\/p>\n<p>      Stating aforesaid, it was submitted that the matter may be<br \/>\nreheard to consider the ratio of Mohan and Shakuntala Singh\n<\/p>\n<p>                                                                2&#8230;..\n<\/p>\n<p>                   R.P. No.569 of 2010.\n<\/p>\n<p>12.11.2010<\/p>\n<p>(supra) in which different view has been taken by two different<br \/>\nSingle Bench of this Court. After going through the order dated<br \/>\n13.8.2010 in the aforesaid cases, in <a href=\"\/doc\/89808919\/\">Shakuntala Singh vs.<br \/>\nBasant Kumar Thakur &amp;<\/a> ors [2003(3) MPLJ 414] and Mohan<br \/>\n@ Munna Pachauri vs. Jagdish Chandra Dubey [ILR 2008<br \/>\nMP 1402], we find that the aforesaid contention is misconceived.\n<\/p>\n<p>      In Mohan     @ Munna Pachauri (supra), learned Single<br \/>\nJudge was considering the question of exclusion of a period<br \/>\nspent in obtaining the certified copy in filing an application<br \/>\nunder Order 9 Rule 13 CPC while in Shakuntala Singh (supra)<br \/>\nanother Single Bench of this Court was considering the question<br \/>\nin respect of condonation of delay of period spent in obtaining<br \/>\nthe certified copy of the judgment and decree for filing an<br \/>\napplication under Order 9 Rule 13 CPC. The Division Bench in<br \/>\nthe aforesaid cases by order dated 13.8.2010 found that there<br \/>\nis no conflict of judgment in both the cases and decided the<br \/>\nreference in para 18 of the order.\n<\/p>\n<p>      In view of the aforesaid discussion, we do not find any<br \/>\nmerit in these review petitions.
