Justice K.SURENDRA MOHAN\n\n Dated :10\/08\/2010\n\n O R D E R\n                 K.SURENDRA MOHAN, J.\n              -------------------------------------------\n                  W.P.(C) No.6030 of 2010\n              -------------------------------------------\n             Dated this the 10th August, 2010\n\n                           JUDGMENT\n<\/pre>\n<p>    The petitioner has filed this writ petition challenging<\/p>\n<p>the action initiated by the first respondent bank for<\/p>\n<p>recovery of amounts from the guarantor of a loan<\/p>\n<p>transaction that the petitioner has with the bank.<\/p>\n<p>According to the petitioner, the amount was actually<\/p>\n<p>availed under a Group Deposit Scheme and since there<\/p>\n<p>was default in repayment of the amounts, the same was<\/p>\n<p>converted into a personal loan.\n<\/p>\n<p>     2. The petitioner is a persistent defaulter who had<\/p>\n<p>defaulted repayment of another loan and had availed the<\/p>\n<p>present loan for the purpose of closing the earlier loan<\/p>\n<p>that was remaining in default. It is submitted that the<\/p>\n<p>bank was persuaded to sanction the loan on the guarantee<\/p>\n<p>of the person who had stood as surety. The surety had<\/p>\n<p>bound himself to repay the amount to the bank and<\/p>\n<p>therefore, the bank has the right to proceed against the<\/p>\n<p>said person for the recovery of the amount due. In view of<\/p>\n<p>the above, it is submitted that the petitioner is not entitled<\/p>\n<p>to any of the reliefs claimed in this writ petition.<\/p>\n<p><span class=\"hidden_text\">wpc No.6030\/2010          2<\/span><\/p>\n<p>         3. The counsel for the petitioner submits that the<\/p>\n<p>   petitioner is ready to pay the entire amount that is due<\/p>\n<p>   provided he is permitted to make payments in six monthly<\/p>\n<p>   instalments. The counsel for the bank opposes the grant<\/p>\n<p>   of any such facility to pay the amount due in instalments.<\/p>\n<p>   However, he assures that if the petitioner approaches the<\/p>\n<p>   bank with a suitable request for such facility, the bank<\/p>\n<p>   would certainly consider the same sympathetically.<\/p>\n<p>         4. In the above circumstances, this writ petition is<\/p>\n<p>   disposed of directing the petitioner to submit a proper<\/p>\n<p>   representation to the first respondent seeking payment of<\/p>\n<p>   the balance amount payable by him in instalments within<\/p>\n<p>   two weeks from the date of receipt of a copy of this<\/p>\n<p>   judgment.
