   and decree dated 31.10.2002 in OS.  307\/I994 passed<\/p>\n
 by the Principal CiviI Judge (Junior Division) at Davangere.<\/p>\n
2. The appellants are the legal representatives o_tT3V.delee2:;’s;’e–<,i_:l  .<\/p>\n
plaintiff – K. Shivanna and the respondents  the de_l"elnd'ants .hefoi"~'3.<\/p>\n
the Trial Court. In this judgment for convenience the  are <\/p>\n

3. It is the ease of the absolute owner in
\npossession and enjoyment of   having
\nacquired the  eteeeeteaee 23.04.1970.\n<\/p>\n
Since the   of plaint schedule
\nproperty  had construction, the plaintiff filed<\/p>\n
o.s. No. 307\/’i994 _re\u00a3’  declare that he is the absolute<\/p>\n
pwner  plaint seh’edule property, for mandatory injunction to<\/p>\n
l”remo’ve_V the *ur1authoi*ised construction and also for permanent<\/p>\n
injlunethipn. V’ ” ll<\/p>\n
  ‘A :  Defendant No. l entered appearance before the Trial Court,<\/p>\n
._file’d Written statement inter alia contending that plaintiff is not in<\/p>\n
possession of the plaint schedule property and that  r;o’t,thei * <\/p>\n
owner of the same. Further it is contended’that’the ‘plai.nt.isehedule\u00ab’ <\/p>\n
property as described in the plaint schedule iS’.t__1(Zit’ existe-nc’ei. <\/p>\n
the matter stood at that stage

\nbefore the Trial Court. Aftercompletion’olieyiid-ence, iiatitheiristance
\nof plaintiff, a Court Commissioner’ submitted a
\nreport and sketch as    submitted by
\nthe Court   the plaint schedule.\n<\/p>\n
The first   i.obli<aation to reappreciate the
\nentire pleadi'iags;* oral  evidence on record. The first<\/p>\n

 furnished in the plaint schedule, amended<\/p>\n

 AA schedule' furnished in the sketch prepared by the Court<\/p>\n
 _Commi_ssioner  per Ex.C.2. This variance in these documents is<\/p>\n
 -.no_t..iexplained neither by amending the pleadings nor by adducing<\/p>\n

additional evidence. ln the absence of any such  <\/p>\n
evidence explaining the variance in the schedule the _t’irst_:’A.ppe:llate<\/p>\n
Court rightly concluded that the plaintiff<\/p>\n
establish his case against the defendan’ts,_<\/p>\n
10. In the plaint it is   ‘easternside of the
\nplaint schedule property, the   l is situated
\nand he has  on its western
\nside. In the   plaintiff before the
\nTrial Courjiit   2 has encroached to an
\nextent of guntasi  side of plaint schedule property.<\/p>\n
Further   seen thattne ‘alleged encroachment specified in the<\/p>\n
S plaint  amended rough”s’ketch do not tally with Ex.P.l — the sale<\/p>\n
  —- the sketch prepared by the Court<\/p>\n
”  Comn1i_ssioner.”Eifappreciating this evidence on record the first<\/p>\n
 Appellate ‘Court rightly concluded that in the absence of necessary<\/p>\n
V’ pleadings; and evidence explaining this variance in furnishing the<\/p>\n
schedule the plaintiff has failed to prove the case. Therefor\u00e9; the   ~<\/p>\n
question of law is answered in affirmative.   ._
