RAMACHANDRA MENON, J.\n                 -----------------------------------------------\n                        WP(C) No. 37820 of 2009\n                       -------------------------------------\n               Dated, this the 1st day of January, 2010\n\n\n                              J U D G M E N T\n<\/pre>\n<p>       The petitioner has approached this Court seeking for permission<\/p>\n<p>to participate in the District Level Youth Festival being conducted at<\/p>\n<p>Ernakulam. The case of the petitioner is that she is proficient in<\/p>\n<p>performing &#8216;Kuchupudi&#8217; and some other dance forms. However, in the<\/p>\n<p>Sub District level competition for &#8216;Kuchupudi&#8217;, she secured only 2nd place<\/p>\n<p>with &#8216;A&#8217; Grade. The reason stated in the Writ Petition is that during the<\/p>\n<p>performance, the &#8216;stud screw&#8217; of the ear ring worn by an earlier<\/p>\n<p>participant, lying on the stage, pierced the foot of the petitioner and<\/p>\n<p>there was a momentary break in the performance. The learned counsel<\/p>\n<p>for the petitioner submits that the petitioner approached this Court<\/p>\n<p>mainly aggrieved by the fact that the appeal preferred against the<\/p>\n<p>decision is kept pending, notwithstanding the fact that the District level<\/p>\n<p>competitions are already scheduled to be held on 03.01.2010.<\/p>\n<p>       2.    The learned Senior Government Pleader appearing for the<\/p>\n<p>respondents 1 to 3 submits that the appeal preferred by the petitioner<\/p>\n<p>has already been considered and final orders have been passed on<\/p>\n<p>10.12.2009, rejecting the same. A copy of the said order is also<\/p>\n<p>WP(C) No. 37820 of 2009<br \/>\n<span class=\"hidden_text\">                                      2<\/span><\/p>\n<p>produced before this Court for perusal. The learned Senior Government<\/p>\n<p>Pleader also submits on the basis of the instructions, that there is<\/p>\n<p>considerable difference between the performance of the petitioner and the<\/p>\n<p>candidate who secured the 1st place by a margin of 13 marks.<\/p>\n<p>      In the above facts and circumstances, this Court does not find any<\/p>\n<p>merit in this Writ Petition. Interference is declined and the Writ Petition is<\/p>\n<p>dismissed accordingly.\n<\/p>\n<\/p>\n<p>                                       P. R.
