Through Principal Secy.Housing And\n                      Urban Lko.\n                      Petitioner Counsel :- Vaibhav Raj\n                      Respondent Counsel :- C.S.C.,D.K.Upadhyay\n\n                      Hon'ble Uma Nath Singh,J.\n<\/pre>\n<p>                      Hon&#8217;ble Devendra Kumar Arora,J.\n<\/p>\n<p>                      Heard learned counsel for parties and perused the pleadings.<br \/>\n                      It appears that a Housing Scheme, known as &#8216;Vyom Khand Yojna&#8217;,<br \/>\n                      Gomti Nagar, Lucknow, was cancelled on account of a Public<br \/>\n                      Interest Litigation as the area was alleged to be falling in a green<br \/>\n                      belt. Accordingly, the scheme was cancelled and the applicants<br \/>\n                      were refunded the deposits with interest. The petitioner is one of<br \/>\n                      such applicants who has prayed for issuance of\n<\/p>\n<p>(i) &#8221; a writ, order or direction in the nature of certiorari for quashing the<br \/>\nresolution\/decisions of the LDA board dated 13.08.2009 as far as it is related to<br \/>\nconcellation of allotment of plot of petitioner by summoning the same from<br \/>\nopposite parties;\n<\/p>\n<p>(ii) a writ order direction in the nature of mandamus commanding the opposite<br \/>\nparties to revive the Vyom Khand Yojna and to execute the sale deed\/registry in<br \/>\nfavour of the petitioners&#8217; for their respective plots allotted in the year 2005 as<br \/>\nper the condition of the brochure and as soon as possible or within stipulated<br \/>\ntime frame as this Hon&#8217;ble court may deem fit and proper;\n<\/p>\n<p>(iii) a writ, order or direction in the nature of mandamus commanding the<br \/>\nopposite parties specially the LDA not to take any action for enforcement and<br \/>\nimplementation of the impugned resolution\/decision dated 13.08.2009, and\n<\/p>\n<p>(iv) any other writ, order or direction which this Hon&#8217;ble Court may deem fit<br \/>\nand proper in the circumstances of the case.&#8221;\n<\/p>\n<p>                      As the Housing Scheme itself was cancelled and the deposits were<br \/>\n                      refunded with interest, learned counsel for LDA, Sri.D.K.Upadhyay<br \/>\n while placing relilance on a judgment of the Apex Court reported in<br \/>\n(1994) 4 SCC 42,Ghaziabad Development Authority Vs. Delhi<br \/>\nAuto &amp; General Finance Private Ltd and Others contended that<br \/>\nthere would be no legitimate expectation on the part of applicants to<br \/>\nget allotment under some other schemes also.\n<\/p>\n<p>Paras 8, 10 and 11 of the judgment, being relevant are reproduced<br \/>\nhere under:-\n<\/p>\n<blockquote><p>    8. It is difficult to appreciate how the change of the<br \/>\n       area in the master plan from &#8216; recreational&#8217; to<br \/>\n       &#8216;residential&#8217; could give rise to a legitimate<br \/>\n       expectation in a private coloniser owning land in<br \/>\n       that area that he could construct a housing colony<br \/>\n       therein simply because he had submitted some<br \/>\n       plan for approval, when grant of the permission<br \/>\n       under Section15 of the U.P. Act is not automatic<br \/>\n       and the statute permitted amendment of the<br \/>\n       master plan by change of the land use even<br \/>\n       thereafter. The mere fact that the area was shown<br \/>\n       originally as meant for &#8216; recreational&#8217; use, shows<br \/>\n       that reversion to the original land use is equally<br \/>\n       permitted by the statute. No legitimate expectation<br \/>\n       of the kind claimed by these private colonisers<br \/>\n       could arise on these facts and in a situation like<br \/>\n       this clearly contemplated by the statute itself.\n<\/p><\/blockquote>\n<blockquote><p>    10.As earlier indicated, the decision in <a href=\"\/doc\/298443\/\">Food Corp. of<br \/>\n       India vs Kamdhenu Cattle Feed Industries<\/a> clearly<br \/>\n       says that legitimate expectation does not form an<br \/>\n       enforceable right to provide an independent<br \/>\n       ground of challenge. The modified stand taken by<br \/>\n       the learned counsel for respondents on this aspect<br \/>\n       is equally met by this proposition. In substance the<br \/>\n      contention of learned counsel for the respondents<br \/>\n      is that the planning commitments and the<br \/>\n      investment made by the two private colonisers<br \/>\n      confer on them or at least on Maha Maya the<br \/>\n      indefeasible right to grant of the permission and<br \/>\n      sanctioned of their lay-out plan which cannot be<br \/>\n      defeated by exercise of the power of amendment of<br \/>\n      the master plan under Section 13 of the U.P. Act.<br \/>\n      The fallacy in this contention is that it upgrades<br \/>\n      the so-called legitimate expectation, assuming it to<br \/>\n      be so in the present case, to a legally<br \/>\n      unforeseeable right which a legitimate expectation<br \/>\n      is not, it being merely a part of the rule of<br \/>\n      nonarbitrariness to ensure procedural fairness of<br \/>\n      the decision. It is clear that the requirments of<br \/>\n      public interest can outweigh the legitimate<br \/>\n      expectation of private persons and the decision of<br \/>\n      a public body on that basis is not assailable. This<br \/>\n      contention of learned counsel for the respondents<br \/>\n      fails.\n<\/p><\/blockquote>\n<p>   11.Before dealing with the remaining submission, it<br \/>\n      would be appropriate to refer to certain provisions<br \/>\n      of the Uttar Pradesh Urban Planning &amp;<br \/>\n      Development Act, 1973 and the National Capital<br \/>\n      Region Planning Board Act, 1985( referred<br \/>\n      hereafter as &#8220;NCR Act&#8221;).\n<\/p>\n<p>However, Sri D.K.Upadhyay also submitted that the Lucknow<br \/>\nDevelopment Authority has proposed, that if such applicants who<br \/>\nhad applied in &#8216;Vyom Khand Yojna&#8217;Gomti Nagar, Lucknow apply<br \/>\n                          in some Multi Storied Flats Scheme, they would be given special<br \/>\n                         weightage including some concession in the matter of payments.<br \/>\n                         We appreciate the gesture, shown by the authority, however, in<br \/>\n                         view of the judgment of Supreme Court(supra), since the petitioners<br \/>\n                         have no legal right, we are not inclined to grant the relief as prayed<br \/>\n                         for.\n<\/p>\n<p>                         Thus, this writ petition is disposed of, while noting the statement of<br \/>\n                         Sri D.K.
