DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 12\/11\/2008 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>Heard<br \/>\n\tlearned counsel for the parties.\n<\/p>\n<p>Rule.\n<\/p>\n<p>\tMr.Vipul Mistry, learned AGP and Mr.A.V.Prajapati, learned counsel<br \/>\n\tappear and waive service of notice of rule for respective<br \/>\n\trespondents.\n<\/p>\n<p>This<br \/>\n\tpetition under Article 226 of the Constitution of India is filed by<br \/>\n\tthe petitioner with a prayer to quash and set aside the order dated<br \/>\n\t9\/11-7.2008 passed by the Secretary (Appeal), Revenue Department,<br \/>\n\tState of Gujarat in Revision Application No.MVV\/HKP\/Pancham\/8\/<br \/>\n\t2008(Dasu) by which the revision application preferred by the<br \/>\n\tpetitioner came to be rejected on the ground of delay.\n<\/p>\n<p>The<br \/>\n\tpetitioners are the owners and occupiers of the land baring survey<br \/>\n\tNo.389 admeasuring 5 acres and 29 gunthas of village Tadva, Taluka<br \/>\n\tSahera, Dist. Panchmahal and according to them they are in actual<br \/>\n\tand physical possession of the subject land as owners.\n<\/p>\n<p>So<br \/>\n\tfar as petitioner No.1 is concerned, part of the subject land was<br \/>\n\tpurchased by executing sale deed dated 2.4.1997 by the original<br \/>\n\towner Shri Chandubhai Jesingbhai i.e. father of respondents Nos.4 to\n<\/p>\n<p>\t6. Pursuant to the registered sale deed executed by the original<br \/>\n\towner, names of the petitioners came to be mutated in revenue<br \/>\n\trecords by mutation entry No.1691 and 1692 dated 18.3.1999.  The<br \/>\n\tabove mutation entries came to be challenged by the respondents<br \/>\n\twhich came to be dismissed in RTS Appeal by an order dated 9.10.2003<br \/>\n\tconfirming both the above entires.  Against which RTS Revision<br \/>\n\tApplication No.8 of 2005 was preferred by the respondents herein<br \/>\n\tbefore the District collector and vide order dated 26\/28.07.2005 the<br \/>\n\torder passed by the Deputy Collector dated 9.10.2003 came to be<br \/>\n\tquashed and set aside and cancelled both the entries Nos.1691 and<br \/>\n\t1692 on the ground that the subject land was restricted tenure land<br \/>\n\tas per Section 43 of the Bombay Tenancy and Agricultural Act and<br \/>\n\tsale transactions were illegal.\n<\/p>\n<p>Against<br \/>\n\twhich the revision application was preferred in the year 2008 being<br \/>\n\tRevision Application No.8 of 2008 which same to be rejected by the<br \/>\n\tRevisional Authority vide order dated 9\/11.7.2008 on the ground that<br \/>\n\tsufficient cause was not shown for delay of more than two and half<br \/>\n\tyears.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the petitioners contend that as such there is no time<br \/>\n\tlimit prescribed for preferring revision application before the<br \/>\n\tRevisional Authority under Section 211 of the Code.  Not only that<br \/>\n\tbut in the memo of revision application in ground No.7 sufficient<br \/>\n\treasons were shown for delay in preferring application and<br \/>\n\tjustification for the same, which was not considered in proper<br \/>\n\tperspective.  Learned counsel for the petitioners even relied on<br \/>\n\tvarious decisions in the context of applicability of Section 5 of<br \/>\n\tthe limitation Act and submitted that for doing substantial justice,<br \/>\n\tthe concerned authority ought to have been condoned the delay in<br \/>\n\tfiling the revision application by the petitioner.\n<\/p>\n<p>Mr.Prajapati,<br \/>\n\tlearned counsel for the private respondents submits that though<br \/>\n\tsufficient notices were given to the petitioners by the authority<br \/>\n\tconcerned, due care and diligence was not shown by them and the<br \/>\n\tpetitioners herein never remained present either before the Deputy<br \/>\n\tCollector or the Collector, and therefore, when the transaction in<br \/>\n\tquestion was hit by Section 43 of the Act the order passed by the<br \/>\n\tCollector is just and proper.  Not only that but the delay in<br \/>\n\tpreferring  revision application is rightly rejected by the<br \/>\n\tRevisional Authority after taking into consideration all the<br \/>\n\trelevant aspects and providing sufficient opportunity of hearing to<br \/>\n\tthe petitioners.  According to learned counsel for the private<br \/>\n\trespondents, the petitioners herein are consistent in their approach<br \/>\n\tand attitude in not remaining present before the authorities below,<br \/>\n\tand therefore also, they do not deserve any relief in exercise of<br \/>\n\tpower under Article 226 of the Constitution of India.\n<\/p>\n<p>Heard<br \/>\n\tlearned AGP who supports the arguments of the learned counsel for<br \/>\n\tthe private respondents.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the parties and perusing the record of the<br \/>\n\tcase, I am inclined to accept the arguments of the learned counsel<br \/>\n\tfor the petitioners inasmuch as there was no justification for the<br \/>\n\trevisional authority for not considering sufficient cause shown to<br \/>\n\tthe petitioners for delay in filing the revision application.  No<br \/>\n\tother reasons are given by the Revisional Authority to ground 7 of<br \/>\n\tthe memo of revision application in which explanation was rendered<br \/>\n\tby the petitioner for delay in filing the revision application.  It<br \/>\n\tgoes without saying that when there is merit or substance in the<br \/>\n\tsubject, justice demands procedure is to be followed in toto and<br \/>\n\tapproach of the authority exhibits lacking understanding of exercise<br \/>\n\tof revisional jurisdiction in its proper perspective.  Decision<br \/>\n\trelied by the learned counsel for the petitioner in the case of<br \/>\n\t<a href=\"\/doc\/1117226\/\">Collector, Land Acquisition, Anantnag v. Mst.Katiji<\/a> reported<br \/>\n\tin in AIR 1987 SC 1353 is applicable to the facts and<br \/>\n\tcircumstances of the case.\n<\/p>\n<p>In<br \/>\n\tview of the above, this petition is allowed and the order dated<br \/>\n\t9\/11.7.2008 passed by the learned Secretary (Appeals), Revenue<br \/>\n\tDepartment, State of Gujarat in Revision Application<br \/>\n\tNo.MVV\/HKP\/Pancham\/8\/2008 (Dasu) is hereby quashed and set aside and<br \/>\n\tthe matter is remanded to the authority concerned for taking<br \/>\n\tappropriate decision in accordance with law within a period of  8<br \/>\n\tweeks from today.\n<\/p>\n<p>Accordingly,<br \/>\nthis Special Civil Application. Rule is made absolute to the<br \/>\naforesaid extent only.\n<\/p>\n<p>(ANANT S.
