PRAKASH TATIA, J.\n<\/pre>\n<p>       Mr.Anil Bhandari, for the appellant.\n<\/p>\n<p>                                 &#8211; &#8211; &#8211; &#8211; &#8211;\n<\/p>\n<p>REPORTABLE<br \/>\n             Heard learned counsel for the appellant.\n<\/p>\n<p>             Appellant,   owner    of    the    vehicle,       has    preferred<br \/>\n       this appeal to challenge the award dated 28.7.2007 by<br \/>\n       which the claim petition of the claimant was allowed<br \/>\n       and   the   tribunal    exonerated      the   appellant        insurance<br \/>\n       company from the liability but directed the insurance<br \/>\n       company to first pay the award amount to the claimant<br \/>\n       and   allowed   the     insurance      company     to    recover      said<br \/>\n       amount from the appellant, owner of the vehicle.\n<\/p>\n<p>             The   appellant    has     not    deposited       the    requisite<br \/>\n       amount under Section 173 of the Motor Vehicles Act,<br \/>\n       1988 (for short &#8216;the Act of 1988&#8217;) and, therefore, the<br \/>\n       office has raised objection upon which learned counsel<br \/>\n       for the appellant submitted that the initial liability<br \/>\n<span class=\"hidden_text\">                                       2<\/span><\/p>\n<p>                                     S.B. Civil Misc. Appeal No.5615\/2008 DR(J)<br \/>\n                                                Lila Ram. vs. Smt. Jhamka &amp; Ors.\n<\/p>\n<p>to   make   payment      of    the    award     amount      is    open     the<br \/>\ninsurance company and the entire award amount has been<br \/>\ndeposited    or   paid    by    the       insurance     company      to    the<br \/>\nclaimants, therefore, the appellant is not required to<br \/>\nmake any payment under the award and, therefore, the<br \/>\ncondition to deposit under Section 173 of the Act of<br \/>\n1988    cannot    be     enforced          against      the      appellant.<br \/>\nTherefore, the appellant can challenge the award by<br \/>\npreferring appeal without depositing the amount under<br \/>\nSection 173 of the Act of 1988.\n<\/p>\n<p>       Learned counsel for the appellant relied upon the<br \/>\njudgment of this Court in the case of Ghisi Bai (Smt.)<br \/>\n&amp; Ors. Vs. Smt. Magan Kanwar &amp; Ors. reported in 2006<br \/>\nR.A.R. 181 (Raj.) (by me) wherein it has been held that<br \/>\nonce the insurance company has deposited the awarded<br \/>\namount or paid to the claimants, then the appellant<br \/>\ncannot be asked to deposit any more amount, otherwise<br \/>\nit will amount to paying an amount exceeding liability<br \/>\nunder the award.\n<\/p>\n<p>       I considered the submissions of learned counsel<br \/>\nfor the appellant and perused the judgment delivered in<br \/>\nthe case of Ghisi Bai (supra).\n<\/p>\n<p><span class=\"hidden_text\">                                      3<\/span><\/p>\n<p>                                     S.B. Civil Misc. Appeal No.5615\/2008 DR(J)<br \/>\n                                                Lila Ram. vs. Smt. Jhamka &amp; Ors.\n<\/p>\n<p>      Proviso to Sub-Section (1) of Section 173 of the<br \/>\nAct of 1988 reads as under :-\n<\/p>\n<blockquote><p>      &#8220;Provided that no appeal by the person who is<br \/>\n      required to pay any amount in terms of such award<br \/>\n      shall be entertained by the High Court unless he<br \/>\n      has deposited with it twenty-five thousand rupees<br \/>\n      or fifty per cent of the amount so awarded,<br \/>\n      whichever is less, in the manner directed by the<br \/>\n      High Court.&#8221;<\/p><\/blockquote>\n<p>      It is clear from the above proviso to Sub-Section<br \/>\n(1) of Section 173 of the Act of 1988 that any person<br \/>\nwho   is   challenging       the   award      of    the     Tribunal,       is<br \/>\nrequired to pay twenty-five thousand rupees or fifty<br \/>\nper   cent      of    the   amount       awarded     by    the     Tribunal<br \/>\nwhichever is less, for preferring the appeal before the<br \/>\nHigh Court. The language used in the above proviso is<br \/>\n&#8220;required to pay any amount in terms of such award&#8221;. In<br \/>\ncase, where the insurance company has been directed to<br \/>\npay the award amount to the claimants holding it liable<br \/>\nfor the said amount and the amount is paid by the<br \/>\ninsurance company to satisfy their liability under the<br \/>\naward, then no amount remained due which is required to<br \/>\nbe paid in terms of the award either by the insurance<br \/>\ncompany    or    by   the   insured.       Therefore,       any     one    can<br \/>\nprefer appeal to challenge the award without making<br \/>\n<span class=\"hidden_text\">                                            4<\/span><\/p>\n<p>                                           S.B. Jhamka &amp; Ors.\n<\/p>\n<p>payment under Proviso to Sub-Section (1) of Section 173<br \/>\nof the Act of 1988 and in that situation, the private<br \/>\nparty, owner of the vehicle or driver of the vehicle<br \/>\ncan    file    the     appeal           without       depositing      the     above<br \/>\nreferred amount.\n<\/p>\n<p>      The situation is different when the Tribunal has<br \/>\npassed the award exonerating the insurance company but<br \/>\ndirected the insurance company to first pay the award<br \/>\namount to the claimants and then recover it from the<br \/>\nowner. In that situation, when the insurance company<br \/>\npaid or deposited the entire awarded amount, then the<br \/>\ninsurance company&#8217;s right under the award to recover<br \/>\nthe amount from the owner of the vehicle remains as it<br \/>\nis    and   that      is    the        liability      of    the   owner     of   the<br \/>\nvehicle       under        the    award,        may    it    be    towards       the<br \/>\ninsurance      company.           In     that     situation,        the     private<br \/>\nparty,      owner      of        the     vehicle      is    a     person     having<br \/>\nliability &#8220;required to pay the amount in terms of the<br \/>\naward&#8221;. Such owner &#8211; insured, therefore, is required to<br \/>\ncomply with the condition of Proviso to Sub-Section (1)<br \/>\nof Section 173 of the Act of 1988.\n<\/p>\n<p>      In the case of Ghisi Bai (supra), this Court held<br \/>\nonly that &#8220;where the award amount has already been paid<br \/>\nin pursuance of the award either by the appellant or<br \/>\n<span class=\"hidden_text\">                                              5<\/span><\/p>\n<p>                                             S.B. Jhamka &amp; Ors.\n<\/p>\n<p>          insurance company, then he cannot be asked to deposit<br \/>\n          any   more     amount    because   it    will     be    directing        the<br \/>\n          appellant to pay the amount exceeding his liability<br \/>\n          under the award.&#8221;. The said judgment is also clear and<br \/>\n          it is only held that when there is no liability under<br \/>\n          the award of anybody including the appellant, then he<br \/>\n          need not to deposit the amount under Proviso to Sub-<br \/>\n          Section (1) of Section 173 of the Act of 1988. The said<br \/>\n          judgment in fact is also against the appellant.\n<\/p>\n<p>                In   view    of    the   above    reasons,       the    contention<br \/>\n          raised by the appellant is rejected.\n<\/p>\n<p>                However, the appellant is permitted to cure the<br \/>\n          defect by making payment of requisite amount within a<br \/>\n          period of eight weeks from today.\n<\/p>\n<p>                Defect      No.3    regarding     mentioning           of   age     is<br \/>\n          dispensed with.\n<\/p>\n<p>                Issue notice of the application under Section 5 of<br \/>\n          the Limitation Act returnable in eight weeks.\n<\/p>\n<p>                                                          (PRAKASH TATIA), J.\n<\/p>\n<p>S.Phophaliya\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Rajasthan High Court &#8211; Jodhpur Mr.Anil Bhandari vs Unknown on 17 September, 2008 1 S.B.
