The facts in brief are that the plaintiff\n\niV_ was before the trial Court seeking for a\n\n\"\u00abideciaretion that the judgment and decree dated\n\nf%_fi2.i2.1960 passed in GS.No.?i3\/1960 is a\n\nhcoiiusive decree and is not binding on the\n\nelaintiff. The reason for claiming such a relief\n\nwas that, according to the plaintiff, the third\n\n}\u00bb\n\n\"I\n\n \n\n\n\n&4&\n\ndefendant in the euit had been granted right over\nthe extent of 39 guntas inclusive of the extent\nof 20 guntas of the suit schedule property.\u00bb The\n\nsaid. right, according to the plaintiff,--twaeedby\n\nway of a maintenance deed dated 13.3.i958;t#hiehr\n\nwas executed by the eeceed defe\ufb01dent? ehc is the\nbrother of the third defehdahtiS\ufb01te\ufb01anjamma. The\nsaid Smt.Manjamma,gWehe\u00a3 had aacquired right in\nrespect of the 3\u00a7_\u00a7\ufb01n\u00a7ag ef iand in Sy.No.25, had\nsold an eeteht ef 2S=euetee*to Manajanna by sale\ndeed dated \u00e9\u00a7\u00a7ii@1\u00a7Sd?=@hereafter, Manjanna said\nthe saeee#tovVLattane:=dewda by sale deed dated\n\n29,2\u00a3i968. Subeequently, the plaintiff is said to\n\niha\ufb01e eetcheeed the extent of 20 guntas under a\n\nA\"5ele \"deed \ufb02d\u00e9ted 4.11.1976. Therefore, the\n\nplaintiff ciaiming to be the lawful owner of the\n\nu\"\", \"suit \"schedule property\" had instituted the suit\n\ni\ufb01ciai\ufb01ing that when Smt.Manjamma bad right over\n\nE\"e; the said property in View of the maintenance deed\n\ndated 13.3.1958 the defendants 1 and 2 could not\n\nhave filed a 'suit in OS.No.113\/1960 and in the\n\n12\n\n\n\n.-5\u00bb\n\nsaid, suit, the right of Smt.Manjamma could _not\n\nhave been given up so as to effect partition \ufb02y\n\nexcluding Smt.Manjamma. It is in that Aeoateata'\n\nthe plaintiff contended theta the ;\u00a7aia\u00a7jj\ufb01agaenti\"\n\nand decree dated 12.i2.1\u00a7e\u00a7 in 05 ac il\u00e9xi\u00e9so is'\n\na collusive one so ea to defeat the right of the\nplaintiff. Since the plaintifg \ufb01gd Qurchased the\nproperty undere thew iaaidja_aaielu deed dated\n4.11.1975<\/pre>\n

\njudgment._and Vae\u00a7ra\u00e9\u00ab ofl permanent injunction iaas

the auit of the plaintiff. The trial Court had<\/p>\n
lfra\ufb01ed\u00b0as many as five issues initially and three<\/p>\n

5. A perusal of the judgment passed by the<\/p>\n
trial Court would indicate that the trial Court<\/p>\n
has referred to the evidence rendered by gthe<\/p>\n
parties. In so far as the right claimed by the<\/p>\n
plaintiff to the property, the trial lCeert’ heel $_<\/p>\n

ld\ufb01agjenna and thereafter Sri.Manjanna had seld 25<\/p>\n
“vii: gnntas of land to Lakkana Gewda by sale deed<\/p>\n
dated 29.2.1968 and thereafter, the plaintiff had<\/p>\n
purchased 20 guntas of land under sale deed dated<\/p>\n

matter the lower appellate Court has noticed that<\/p>\n
the suit in question was filed in the year l9\u00a70<\/p>\n
