SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 18\/09\/2008 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>\tIt<br \/>\nis reported that in spite of the pendency of the present Special<br \/>\nCriminal Application and this Court was seriously considering the<br \/>\nlegality and validity of the impugned order, respondents No.2 and 3<br \/>\nhave left India and they have gone to Australia.  It, prima facie,<br \/>\nappears that when this Court was seriously considering the legality<br \/>\nand validity of the order passed by learned trial Court permitting<br \/>\nthe respondents to go abroad, respondents No.2 and 3 ought not to<br \/>\nhave left India.  It also, prima facie, appears to the Court that<br \/>\nrespondents No.2 and 3 have tried to make the present proceedings<br \/>\ninfructuous and have tried to be too smart. This Court deprecates the<br \/>\nsaid attempt. Shri Baxi, learned advocate appearing for the<br \/>\nrespondents No.2 and 3, has submitted that he will obtain necessary<br \/>\ninstructions from respondents No.2 and 3 and\/or the family member who<br \/>\nis in India whether their presence can be re-secured or not. He may<br \/>\ntake appropriate instructions, failing which appropriate order will<br \/>\nbe passed by this Court to secure the presence of the respondents<br \/>\nNo.2 and 3 and thereafter the present proceedings can be considered<br \/>\non merits.
