Prevention of<br \/>\n\tAtrocity Act, for which, FIR being I-C.R.No.126\/2010 has been lodged<br \/>\n\tat Halvad Police Station.\n<\/p>\n<p>Learned<br \/>\n\tcounsel, Mr.Barot for the applicant referred to the FIR as well as<br \/>\n\tthe statements of the complainant-husband as also the medical<br \/>\n\tevidence and submitted that as stated in the certificate itself that<br \/>\n\tthe victim is married woman and had sex with her husband. He<br \/>\n\tsubmitted that manner in which the offence has taken place therefore<br \/>\n\tcannot be believed or accepted. He further submitted that as now the<br \/>\n\tinvestigation is over, the present application may be allowed in<br \/>\n\tlight of the medical evidence.\n<\/p>\n<p>Learned<br \/>\n\tA.P.P., Mr.Raval resisted the present application.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel, Mr.Barot appearing for the applicant-accused<br \/>\n\tand learned A.P.P., Mr.Raval for the State and having considered the<br \/>\n\tnature of offence, manner in which it is alleged to have been<br \/>\n\tcommitted and medical evidence, the Court is of the opinion that the<br \/>\n\tpresent application deserves to be allowed in light of the<br \/>\n\tguidelines with regard to grant of bail.\n<\/p>\n<p>Accordingly,<br \/>\n\tpresent application stands allowed. The applicant is ordered to be<br \/>\n\treleased on regular bail in connection with I-C.R.No.126\/2010<br \/>\n\tregistered with Halvad Police Station on his executing a bond of<br \/>\n\tRs.5,000\/- (Rupees Five Thousand Only) with one solvent surety of<br \/>\n\tthe like amount to the satisfaction of the lower Court and subject<br \/>\n\tto the conditions that he shall:\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty.\n<\/p>\n<p>(b)\tnot<br \/>\nto try to tamper or pressurize the prosecution witnesses or<br \/>\ncomplainant in any manner.\n<\/p>\n<p>(c)\tnot<br \/>\nact in any manner injurious to the interest of the prosecution.\n<\/p>\n<p>(d)\tmaintain<br \/>\nlaw and order and should cooperate the investigating officers.\n<\/p>\n<p>(e)\tfurnish<br \/>\nthe address of his residence to the Investigating Officer and also to<br \/>\nthe Court at the time of execution of the bond and shall not change<br \/>\nhis residence without prior permission of the Court.\n<\/p>\n<p>(f)\tsurrender<br \/>\nhis passport, if any, to the lower Court, within a week.\n<\/p>\n<p>(g)\tmark<br \/>\nhis presence before concerned Police Station 1st day of<br \/>\nevery calender month between 11:00 AM and 2:00 PM till the trial<br \/>\ncommences.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the concerned<br \/>\n\tSessions Judge will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute.
