Justice K.SURENDRA MOHAN\n\n Dated :29\/11\/2010\n\n O R D E R\n                          R.BASANT &amp;\n                 K.SURENDRA MOHAN, JJ.\n              -------------------------------------------\n                    WPCR No.432 of 2010\n              -------------------------------------------\n            Dated this the 29th November, 2010\n\n                           JUDGMENT\n<\/pre>\n<p>Basant, J.\n<\/p>\n<p>      The petitioner has come to this Court through his power<\/p>\n<p>of attorney holder and mother with this petition for the issue of<\/p>\n<p>a writ of habeas corpus to search for trace and produce his<\/p>\n<p>wife Arsha R.Nair, aged about 24 years (date of birth &#8211;<\/p>\n<p>31\/5\/1986).\n<\/p>\n<p>      2. The petitioner and the alleged detenue Arsha R.Nair<\/p>\n<p>are married. Their marriage was solemnised and registered on<\/p>\n<p>6.3.2009. They had resided at various places. Finally, they<\/p>\n<p>were residing at Vishakapattanam. One child was born in the<\/p>\n<p>wed lock. From 15.7.2010, the alleged detenue &#8211; wife of the<\/p>\n<p>petitioner was missing along with the child. It is in these<\/p>\n<p>circumstances that the petitioner came to this court with this<\/p>\n<p>petition on 3.11.2010.\n<\/p>\n<p>      3. This petition came up for admission hearing on<\/p>\n<p>4.11.2010.   The Bench was not pleased to admit the writ<\/p>\n<p><span class=\"hidden_text\">WPCR No.432 of 2010       2<\/span><\/p>\n<p>petition. Notice was not ordered. But the learned Government<\/p>\n<p>pleader was requested to take instructions and make<\/p>\n<p>submissions to enable us to decide on the question of<\/p>\n<p>admission. The matter was posted to this date.<\/p>\n<p>      4. Though the petition has not been admitted and no<\/p>\n<p>directions were issued to the alleged detenue to appear before<\/p>\n<p>Court today, the alleged detenue is physically present before<\/p>\n<p>this Court today along with her child Devina, aged ten months.<\/p>\n<p>The petitioner is not personally present. His power of attorney<\/p>\n<p>holder &#8211; his mother Savithri amma is present.<\/p>\n<p>      5. We interacted with the alleged detenue. The alleged<\/p>\n<p>detenue states that she is not under any illegal detention or<\/p>\n<p>confinement. She is absolutely free. She has come to her<\/p>\n<p>native   place     and is   residing   with  their   mother    at<\/p>\n<p>Vadasserikonam, Kallambalam, Varkala, Thiruvananthapuram<\/p>\n<p>District along with their daughter Devina and her son Ashik,<\/p>\n<p>born prior to the marriage with the petitioner. She states that<\/p>\n<p>she is not under illegal detention and that she has valid<\/p>\n<p>reasons to stay away from the petitioner.         The power of<\/p>\n<p>attorney of the petitioner states that the petitioner is presently<\/p>\n<p>employed in Africa.\n<\/p>\n<p>      6. In a petition for the issue of a writ of habeas corpus,<\/p>\n<p><span class=\"hidden_text\">WPCR No.432 of 2010        3<\/span><\/p>\n<p>we are primarily concerned with the question whether the<\/p>\n<p>alleged detenue is under any illegal detention or confinement.<\/p>\n<p>We are satisfied in the facts and circumstances of the case that<\/p>\n<p>the alleged detenue is not under any illegal detention or<\/p>\n<p>confinement. The power of attorney holder of the petitioner<\/p>\n<p>prays that opportunity may be given for her to interact with<\/p>\n<p>the child of the petitioner.\n<\/p>\n<p>     7. We are satisfied that the alleged detenues &#8211; the wife<\/p>\n<p>and daughter of the petitioner, are not under any illegal<\/p>\n<p>detention or confinement. We are satisfied that no directions<\/p>\n<p>need be issued under Article 226 of the Constitution now. If<\/p>\n<p>the petitioner himself or his power of attorney holder i.e. the<\/p>\n<p>grandmother of the child wants to seek custody\/visitorial rights<\/p>\n<p>of the child, they shall be at liberty to initiate proceedings<\/p>\n<p>before appropriate court.        The alleged detenue states<\/p>\n<p>categorically that she has no objection whatsoever against the<\/p>\n<p>grandmother of the child, i.e. the power of attorney holder of<\/p>\n<p>the petitioner visiting and interacting with the child at any<\/p>\n<p>convenient time at her residence at Varkala. We record that<\/p>\n<p>submission. We are satisfied that no further directions are<\/p>\n<p>necessary in this writ petition.\n<\/p>\n<p>     8. This writ petition is accordingly dismissed.
