His<br \/>\nbirth certificate maintained by the Registrar of Birth and Deaths,<br \/>\nhowever, records his date of birth as 25.12.82.  The petitioner is<br \/>\nseeking to correct the birth date recorded in  school leaving<br \/>\ncertificate  in conformity  with the birth certificate.  He<br \/>\napproached the school authorities and  when his request was not<br \/>\ngranted, he filed civil suit  being Regular Civil Suit No.20\/08  in<br \/>\nthe court of learned Principal Senior Civil Judge, Godhra who<br \/>\ndismissed the suit by judgment dated 30.1.2009.  The petitioner has<br \/>\ntherefore approached this Court with necessary  prayers for<br \/>\ncorrection of birth date in the school leaving certificate.\n<\/p>\n<p>\tCounsel<br \/>\nfor the Board  drew my attention to the decisions of Division Bench<br \/>\nof this Court wherein view is taken that in such cases, it is not<br \/>\nopen for the school authorities to correct the date of birth once the<br \/>\nstudent has left the school. However,  he has to approach the<br \/>\nconcerned Magistrate  for necessary declaration  and if such<br \/>\ndeclaration is  made, school authority would have to make  the<br \/>\nconsequential correction.  In an order dated  24.6.2009, in Special<br \/>\nCivil Application No.4423 of 2001 and connected matters, referring to<br \/>\nthe decision of Division Bench  dated 11.8.2003 passed in Letters<br \/>\nPatent Appeal No.699 of 2003, Division Bench of this Court made the<br \/>\nfollowing observations:\n<\/p>\n<p>&#8220;These<br \/>\nfour petitions have been placed before us on a reference made on<br \/>\n17.09.2001 by a learned Single Judge in view of the conflicting views<br \/>\ntaken by two other Single Judges of this Court.\n<\/p>\n<p>\t&#8220;The<br \/>\nquestion raised is `whether the School Registers maintained on the<br \/>\nbasis of applications made, shall be varied at the instance of the<br \/>\nstudent after the student leaves the school&#8217;.\n<\/p>\n<p>\tRegulations<br \/>\ngoverning the secondary schools, i.e. Gujarat Secondary Education<br \/>\nRegulations, 1974, do not permit such variation after a student<br \/>\nleaves the school.  This is the view that was taken by learned Single<br \/>\nJudge, Hon&#8217;ble Ms. Justice Rekha Doshit.  Contrary views were taken<br \/>\nby Hon&#8217;ble Mr. Justice M.S. Shah in Special Civil Application No.7009<br \/>\nof 1999 and Hon&#8217;ble Mr. Justice Pradip Kumar Sarkar in Special Civil<br \/>\nApplication No. 1274 of 2001.\n<\/p>\n<p>\tThis<br \/>\nissue has already been dealt with by a Division Bench of this Court<br \/>\nin Letters Patent Appeal no.699 of 2003, vide order dated 11.08.2003.<br \/>\n The Division Bench has taken the view that once a student leaves the<br \/>\nschool, correction in school records of a student can be carried out<br \/>\nonly by a Magistrate, First Class, having jurisdiction.\n<\/p>\n<p>\tIn<br \/>\nthese Special Civil Applications, corrections are sought for change<br \/>\nof caste as well as change of names.  In view of the aforesaid<br \/>\ndecision of the Division Bench dated 11.08.2003, such corrections can<br \/>\nbe carried out only by a Magistrate, First Class, having jurisdiction<br \/>\non the subject matter, and not by the school authorities.\n<\/p>\n<p>\tWe<br \/>\nfully agree with the view expressed by the Division Bench in Letters<br \/>\nPatent Appeal No.699 of 2003, and dispose of all these matters<br \/>\naccordingly.  All the same, the petitioners, who are desirous of<br \/>\ncarrying out necessary corrections, shall approach respective<br \/>\nMagistrates, First Class, having jurisdiction.\n<\/p>\n<p>\tWith<br \/>\nthe above observations, all the Special Civil Applications stand<br \/>\ndisposed of.\n<\/p>\n<p>\tNotice<br \/>\ndischarged.&#8221;\n<\/p>\n<p>\tIn<br \/>\nview of the above, it would open to the petitioner to approach the<br \/>\ncompetent Magistrate  seeking necessary declaration.  If such<br \/>\napplication is filed, the same should be decided in accordance with<br \/>\nlaw  on the basis of the material that the petitioner may produce,<br \/>\nwith respect to which I express no opinion.
