The petitioner faces<\/p>\n<p>allegations under Section 420 I.P.C.                  The crime has been<\/p>\n<p>registered on the basis of a private complaint filed before the<\/p>\n<p>learned Magistrate and referred to the police under Section 156<\/p>\n<p>(3) Cr.P.C.    Investigation is in progress.               The crux of the<\/p>\n<p>allegations is that amounts handed over by the complainant to<\/p>\n<p>the accused for securing visas have not been returned.<\/p>\n<p>Passports    handed    over      have       also      not   been  returned.<\/p>\n<p>Investigation is in progress.               The petitioners apprehend<\/p>\n<p>imminent arrest.\n<\/p>\n<p>      2.    The learned counsel for the petitioner submits that<\/p>\n<p>the dispute between the complainant and the petitioner have all<\/p>\n<p>been settled already.       Dispute was regarding return of the<\/p>\n<p>passport and money to the de facto complainant by the<\/p>\n<p>petitioner. The same having been settled, there is absolutely no<\/p>\n<p>justification for any arrest and detention of the petitioner.<\/p>\n<p><span class=\"hidden_text\">B.A.No.4734\/07                     2<\/span><\/p>\n<p>Appropriate direction under Section 438 Cr.P.C may be issued in<\/p>\n<p>favour of the petitioner, it is prayed.\n<\/p>\n<p>     3.     The learned Public Prosecutor does not oppose the<\/p>\n<p>application.   The learned Public Prosecutor submits that the<\/p>\n<p>complainant does not appear to be interested in the prosecution<\/p>\n<p>of his complaint. The accused was available for questioning. On<\/p>\n<p>his questioning, it appears that the matter has been settled and<\/p>\n<p>all the disputes have been resolved. In these circumstances,<\/p>\n<p>anticipatory bail   can be granted to the petitioner subject to<\/p>\n<p>appropriate conditions,submits the learned Public Prosecutor.<\/p>\n<p>     4.     In the circumstances explained above, I am satisfied<\/p>\n<p>that appropriate directions under Section 438 Cr.P.C can be<\/p>\n<p>issued in favour of the petitioner. This petition is accordingly<\/p>\n<p>allowed.      Following directions are issued under Section 438<\/p>\n<p>Cr.P.C in favour of the petitioner.\n<\/p>\n<p>     i)     Petitioner  shall    surrender before   the   learned<\/p>\n<p>Magistrate having jurisdiction at 11 a.m on 14\/08\/2007.<\/p>\n<p>     ii)    He shall be released on regular bail on condition that<\/p>\n<p>he executes bond for Rs.25,000\/-(Rupees twenty five thousand<\/p>\n<p>only) with two solvent sureties each for the like sum to the<\/p>\n<p><span class=\"hidden_text\">B.A.No.4734\/07                   3<\/span><\/p>\n<p>satisfaction of the learned Magistrate.\n<\/p>\n<p>      iii)  The petitioner shall make himself available for<\/p>\n<p>interrogation before the investigating officer as and when<\/p>\n<p>directed by the investigating officer in writing to do so.<\/p>\n<p>      (iv) If the petitioner does not appear before the learned<\/p>\n<p>Magistrate as directed in clause (i), directions issued above shall<\/p>\n<p>thereafter stand revoked and the police shall be at liberty to<\/p>\n<p>arrest the petitioner and deal with him in accordance with law,<\/p>\n<p>as if these directions were not issued at all.\n<\/p>\n<p>      (v)   If he were arrested prior to 14\/08\/2007, he shall be<\/p>\n<p>released from custody on his executing a bond for Rs.25,000\/-<\/p>\n<p>(Rupees twenty five thousand only) without any sureties,<\/p>\n<p>undertaking to appear before the learned Magistrate on<\/p>\n<p>14\/08\/2007.<\/p>\n<pre>\n\n\n\n                                             (R.BASANT, JUDGE)\njsr\n\n                 \/\/ True Copy\/\/      PA to Judge\n\n<span class=\"hidden_text\">B.A.No.4734\/07    4<\/span>\n\n<span class=\"hidden_text\">B.A.No.4734\/07    5<\/span>\n\n       R.BASANT, J.\n\n\n\n\n         CRL.M.CNo.\n\n\n\n\n            ORDER\n\n\n\n\n21ST DAY OF MAY2007\n\n<\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Najimudeen @ Najeeb vs State Of Kerala on 7 August, 2007 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl No. 4734 of 2007() 1.
