JUSTICE JYOTI SARAN\n\n                   ORAL ORDER<\/pre>\n<p>                   (Per: HONOURABLE THE CHIEF JUSTICE)<\/p>\n<p>3.   18.02.2011.             In view of the strike call given by the Bihar State Bar<br \/>\n                   Council, none of the Advocates is present.\n<\/p>\n<p>                             Under order dated 23rd March 2010 made by this<br \/>\n                   Court (Coram: Dipak Misra, CJ, as he then was, and Mr<br \/>\n                   Justice Mihir Kumar Jha) the matter at issue was referred to<br \/>\n                   Justice Uday Sinha Committee constituted under order dated<br \/>\n                   11th February 2010 made on L.P.A. No. 1623 of 2009.\n<\/p>\n<p>                             The        aforesaid     Committee       has,   under     its<br \/>\n                   communication dated 14th February 2011, informed this Court<br \/>\n                   that the State functionaries, namely, the Civil Surgeon,<br \/>\n                   Aurangabad and the Civil Surgeon, Madhubani have not<br \/>\n                   responded to the notice of the Committee. On account of non-<br \/>\n                   cooperation     by       the   aforesaid   State   functionaries,   the<br \/>\n                   Committee is unable to proceed further with the matter.\n<\/p>\n<p><span class=\"hidden_text\">                            2<\/span><\/p>\n<p>                  In above view of the matter, we are of the opinion<br \/>\n        that interest of justice will be met if the above referred order<br \/>\n        dated 23rd March 2010 made on Letters Patent Appeal is<br \/>\n        recalled and the Appeal is heard and decided by the Court on<br \/>\n        merits.\n<\/p>\n<p>                  For the aforesaid reason, we recall the order dated<br \/>\n        23rd March 2010 made on L.P.A. No. 552 of 2010. The case<br \/>\n        stands withdrawn from the Committee.\n<\/p>\n<p>                  The Letters Patent Appeal will be notified for<br \/>\n        admission-hearing.\n<\/p>\n<p>                  The Registry will send copy of this order to Justice<br \/>\n        Uday Sinha Committee.<\/p>\n<pre>\n\n                                   ( R.M.
