\n\n    petitioner\n               By     way\n\n                     has\n                            ig   of\n\n                            challenged\n                                        this     Writ\n\n                                               the     Order\n                                                            Petition,\n\n                                                                    of      removal\n                                                                                    the\n                          \n    passed     by    the    Disciplinary          Authority           dated         14th\n\n<\/pre>\n
    February, 2001, a copy of which is annexed Exhibit<\/p>\n
     K   to the Writ Petition.                 By the aforesaid order,<\/p>\n
    the petitioner was subjected to major penalty of<\/p>\n
    removal      from      service        which      shall          not        be        a<\/p>\n
    disqualification for future employment.\n<\/p>\n
    2.         The petitioner joined the services of the<\/p>\n
    Bank as an officer on 16th August, 1975.                            Vide Memo<\/p>\n
    dated     23rd   September,         1999,     the      petitioner               was<\/p>\n
    advised    by    the    Regional         Office,     Mumbai,           that       he<\/p>\n
    stood relieved          at        the close of the office hours<\/p>\n

    on 23rd September, 1999, and to report to the Deputy<\/p>\n
    General Manager, Zonal Office, Bhopal immediately.\n<\/p>\n
    He     had    not    resumed      his    duties    at       Bhopal          and<\/p>\n
    accordingly, he unauthorizedly remained absent from<\/p>\n
    duty.        The petitioner, was accordingly subjected to<\/p>\n
    Chargesheet by way of Memorandum dated 19th April,<\/p>\n
    2000.         The petitioner gave a reply to the said<\/p>\n
    Memorandum         datedig 12th   May,   2000.      A     Departmental<\/p>\n
    Enquiry       was   conducted      against   the      petitioner              by<\/p>\n
    appointing an Enquiry Officer.               The defence of the<\/p>\n
    petitioner was that he was suffering from various<\/p>\n
    ailments and due to that it was not possible for<\/p>\n
    him to resume his duties at Bhopal.                  The petitioner<\/p>\n
    also produced some Medical Certificates during the<\/p>\n
    course of Enquiry to point out that he was ill and<\/p>\n
    at the relevant time it was difficult for him to<\/p>\n
    resume       his    duties.       The    Disciplinary           Authority<\/p>\n
    however, by the impugned Order came to a conclusion<\/p>\n
    that the petitioner committed an act of misconduct<\/p>\n
    by remaining unauthorizedly absent.                     It was found<\/p>\n
    that    his     absence    from    21st September,           1999,        till<\/p>\n

    date of the order of the Disciplinary Authority was<\/p>\n
    treated as unauthorized absence.                           Accordingly, the<\/p>\n
    Order    of    removal     was    passed          by      the       Disciplinary<\/p>\n
    Authority.           The    petitioner            carried             the       matter<\/p>\n
    further before the Appellate Authority by way of<\/p>\n
    preferring      an    Appeal.              The    Appellate               Authority<\/p>\n
    decided the said Appeal by its Order dated 12 th May,<\/p>\n
    2001.     The Appellate Authority did not interfere<\/p>\n
    with     the     Order        passed         by         the         Disciplinary<\/p>\n
    Authority.      The petitioner, thereafter, carried the<\/p>\n
    matter further by way of Review Application but the<\/p>\n
    same was rejected by the Reviewing Authority.\n<\/p>\n
    3.        Being       aggrieved        by        the      said        order,          the<\/p>\n
    petitioner has now approached this Court by way of<\/p>\n
    this Writ Petition.\n<\/p>\n
    4.        Mr.Rahul Nerlekar, the learned counsel for<\/p>\n
    the     petitioner         vehemently            submitted               that         the<\/p>\n
    Disciplinary         Authority,            who     passed              the        Order<\/p>\n
    subsequently         became      the       Appellate             Authority              on<\/p>\n

    account of promotion and the same person, who had<\/p>\n
    decided the matter as Disciplinary Authority has<\/p>\n
    decided the Appeal of the petitioner.                                Therefore,<\/p>\n
    the Order of the Appellate Authority is bad in law<\/p>\n
    as the same has been passed by the same person, who<\/p>\n
    had passed the removal Order against the petitioner<\/p>\n
    while acting as the Disciplinary Authority.\n<\/p>\n
    5.<\/p>\n
               Mr.Ashok D. Shetty, the learned counsel for<\/p>\n
    the    respondents        has    fairly       conceeded            the       aspect<\/p>\n
    that     at      the     relevant           time     the         Disciplinary<\/p>\n
    Authority, who passed the order was the Assistant<\/p>\n
    General       Manager     and        the     same     person           on      being<\/p>\n
    promoted       as      Deputy    General           Manager         became          the<\/p>\n
    Appellate Authority and decided the Appeal of the<\/p>\n
    petitioner.         In our view, the Appeal should not<\/p>\n
    have    been     decided        by    the    same      person,           who       had<\/p>\n
    passed     the      original         Order     as     the        Disciplinary<\/p>\n
    Authority.          The hearing of the Appeal should be<\/p>\n
    meaningful and not a mere formality.                            On this very<\/p>\n
    short ground this Writ Petition is required to be<\/p>\n

    allowed by setting aside the Order of the Appellate<\/p>\n
    Authority     and   remanding          the   matter          back        to      the<\/p>\n
    Appellate Authority.             It is clarified that all the<\/p>\n
    points raised in this Writ Petition are kept open<\/p>\n
    for   the    petitioner      to    urge      the      same       before          the<\/p>\n
    Appellate Authority.\n<\/p>\n
    6.          The Appeal would be decided by one, who has<\/p>\n
    not passed the Order of removal as the Disciplinary<\/p>\n
    Authority.      The Appellate Authority may now decide<\/p>\n
    the Appeal within a period of three months from the<\/p>\n
    receipt of Writ from this Court.                           The Appellate<\/p>\n
    Authority     shall      afford     personal           hearing           to      the<\/p>\n
    petitioner.          We     have       directed           the        Appellate<\/p>\n
    Authority to hear the petitioner, but the same may<\/p>\n
    not be treated as precedent in any other case, as<\/p>\n
    considering     the       time    lag     and      peculiar            facts          &<\/p>\n
    circumstances       of    the     case,      it    is      directed            that<\/p>\n
    personal hearing may be given to the petitioner.\n<\/p>\n
    7.          In view of what is stated above, the Writ<\/p>\n

    Petition   is   allowed.   Rule   is      accordingly               made<\/p>\n
