The land was owned by Shri Naranbhai<br \/>\n\tPatel. It is the case of the petitioner that N.A. permission was<br \/>\n\tgranted with respect to the said land on 22nd November,<br \/>\n\t1964 by Collector, Kheda. Thereupon, Naranbhai Patel sold the land<br \/>\n\tin question to Shri Dayabhai Patel i.e. predecessors-in-title of the<br \/>\n\tpresent petitioner.\n<\/p>\n<p>2.2\tRespondent<br \/>\n\tNo.3, namely, Bhavjibhai Amrabhai claiming tenancy of land in<br \/>\n\tquestion instituted tenancy case before Mamlatdar &amp; ALT by<br \/>\n\tfiling application on 08.02.1966. Mamlatdar &amp; ALT dismissed the<br \/>\n\tapplication on 31.12.1977. Tenancy appeal was filed before Deputy<br \/>\n\tCollector challenging the order of Mamlatdar which was rejected by<br \/>\n\tthe Deputy Collector by an order dated 30th November,<br \/>\n\t1981. Further revision application being TEN\/BA\/888\/82 was allowed<br \/>\n\tby the Tribunal by judgment dated 20th September, 1985.\n<\/p>\n<p>2.3\tThe<br \/>\n\tpetitioner challenged the said decision of the Gujarat Revenue<br \/>\n\tTribunal before this Court by filing Special Civil Application<br \/>\n\tNo.5831 of 1985. In this petition, learned Single Judge by an order<br \/>\n\tdated 22nd July, 1993 remanded the proceedings after<br \/>\n\tquashing the order of the Tribunal for fresh consideration. In the<br \/>\n\torder, the learned Judge held that  There is of course nothing<br \/>\n\ton the record to show that respondent- tenant was aware of grant of<br \/>\n\tsaid N.A.permission or that his consent was obtained for that. Under<br \/>\n\tthe circumstances, the submission of Mr.Patel that provisions of<br \/>\n\tBombay Tenancy Act would not be applicable to the land in question,<br \/>\n\tcannot be sustained .\n<\/p>\n<p>2.4\tGujarat<br \/>\n\tRevenue Tribunal upon remand by its judgment dated 30th<br \/>\n\tApril, 1996 once again allowed the revision application of the<br \/>\n\ttenant. Contention of the petitioner that the land having been<br \/>\n\tconverted to N.A. Land, tenancy would not apply was turned down<br \/>\n\tholding that High Court has already rejected said contention. It may<br \/>\n\tbe noted that the predecessors-in-title of the petitioner was<br \/>\n\trespondent No.2 before the Gujarat Revenue Tribunal when the order<br \/>\n\tdated 30th April, 1996 was being passed. In-fact, present<br \/>\n\tpetitioner representing his father had appeared before the Tribunal<br \/>\n\tand had made detailed submissions.\n<\/p>\n<p>2.5\tThe<br \/>\n\tpetitioner filed a review application against the order of the<br \/>\n\tTribunal which also came to be dismissed by an order dated 25th<br \/>\n\tJune, 1998.\n<\/p>\n<p>2.6\tThereafter,<br \/>\n\tthe Mamlatdar initiated proceedings for fixing the purchase price<br \/>\n\tfor the land in question. Petitioner opposed such proceedings at<br \/>\n\tdifferent stages but significantly never challenged the orders<br \/>\n\tpassed by the Gujarat Revenue Tribunal in the year 1996 and 1998<br \/>\n\twhich are sought to be challenged in this petition. After nearly 12<br \/>\n\tyears, the petitioner has sought to challenge the said orders on<br \/>\n\tseveral grounds.\n<\/p>\n<p>At<br \/>\n\tthis stage, I must note that there are number of inaccurate<br \/>\n\tstatements made by the petitioner on oath.\n<\/p>\n<p>First<br \/>\n\tand foremost, in the petition the petitioner has stated that this<br \/>\n\tCourt by an order dated 22nd July, 1993 simply remanded<br \/>\n\tthe matter to Gujarat Revenue Tribunal for fresh consideration<br \/>\n\tleaving questions open for the Gujarat Revenue Tribunal including on<br \/>\n\tthe point of applicability of the Act with regard to the non<br \/>\n\tagricultural land. In the order passed by this Court,<br \/>\n\thowever, learned Judge as already noted and had recorded and turned<br \/>\n\tdown such a contention.\n<\/p>\n<p>4.1\tSecondly,<br \/>\n\tin the petition, the petitioner has contended that even the Gujarat<br \/>\n\tRevenue Tribunal did not deal with the said contention. Here also,<br \/>\n\tas already noted, Gujarat Revenue Tribunal in its judgment dated<br \/>\n\t30th April, 1996 not only noted but rejected such a<br \/>\n\tcontention on the ground that the High Court has already turned down<br \/>\n\tthe submission.\n<\/p>\n<p>4.2\tOnce<br \/>\n\tagain the petitioner has stated in the petition that for the first<br \/>\n\ttime in the year 1996, through the review application, the<br \/>\n\tpetitioner entered into the picture through the proceedings. As<br \/>\n\tnoted earlier, the petitioner had participated before the Gujarat<br \/>\n\tRevenue Tribunal when the judgment dated 30th April, 1996<br \/>\n\twas passed. His father was party respondent No.2 and the petitioner<br \/>\n\thimself had participated in the proceedings. In fact Special Civil<br \/>\n\tApplication No.5831 of 1985 predecessor-in-title of the present<br \/>\n\tpetitioner may back in the year 1985, ever since then the petitioner<br \/>\n\tis involved in the litigation.\n<\/p>\n<p>4.3\tThough<br \/>\n\tit is stated in the petition that the land was converted into N.A.<br \/>\n\tland, from the record it appears that only a small portion of the<br \/>\n\tland was permitted for non-agriculture use.\n<\/p>\n<p>It<br \/>\n\tis unfortunate that such series of mis-statements are made in the<br \/>\n\tpetition. It cannot be ignored as mere isolated lapse. Some isolated<br \/>\n\tslip or omission can always be overlooked, but such series of gross<br \/>\n\tmis-statements directly conflicting with the material on record<br \/>\n\tcannot be ignored. I am not going into the question whether the<br \/>\n\tpetitioner himself or the draftsman of the petition was responsible<br \/>\n\tfor such mis-statements, leaving it to the good sense of draftsman<br \/>\n\tto ensure that such instances do not recur.\n<\/p>\n<p>On<br \/>\n\tsuch gross mis-statements itself perhaps it would have been possible<br \/>\n\tto dismiss the petition. However, right to approach the Court being<br \/>\n\tfundamental right, I desist from choosing such an option. However,<br \/>\n\teven otherwise, I find that the petition cannot be entertained. The<br \/>\n\tpetitioner has challenged an order passed by the Gujarat Revenue<br \/>\n\tTribunal way back in the year 1996 without proper explanation of<br \/>\n\tdelay. Such gross and inordinate delay of more than 10 years is not<br \/>\n\tproperly explained. The petitioner only pressed in service confusion<br \/>\n\ton his part pursuing proceedings for fixation of sale price and his<br \/>\n\tnon-availability in India as grounds to explain the delay. None of<br \/>\n\tthese grounds could explain the delay of more than 10 years. The<br \/>\n\tpetitioner is an educated person with sufficient means and can and<br \/>\n\thas engaged legal advisers from time to time to assist him.
