 Grounds for the First Appeal:\n<\/p>\n
The reply furnished by the PIO is incomplete and wrong.\n<\/p>\n
Order of the First Appellate Authority (FAA):\n<\/p>\n
        “The PIO is directed to provide the information to the Appellant as agreed by
\nhim during the hearing within a period of 05 days. In case the Appellant does not receive
\nthe information in terms of the aforesaid orders, he may approach the FAA within fifteen
\ndays of the receipt of this order.”\n<\/p>\n
Grounds for the Second Appeal:\n<\/p>\n
No information has been furnished by the PIO despite orders from the FAA to provide
\nthe same within 05 days.\n<\/p>\n
Decision:\n<\/p>\n
The appellant has stated that no information was provided to him despite
\nthe order of the FAA.\n<\/p>\n
The Appeal is allowed.\n<\/p>\n
The PIO is directed to provide the complete information as directed by the
\nFAA before 30 December 2010 to the appellant
\nFrom the facts before the Commission it appears that the PIO is guilty of not furnishing
\ninformation within the time specified under sub-section (1) of Section 7 by not replying
\nwithin 30 days, as per the requirement of the RTI Act. He has further refused to obey the
\norders of his superior officer, which raises a reasonable doubt that the denial of
\ninformation may also be malafide. The First Appellate Authority has clearly ordered the
\ninformation to be given.\n<\/p>\n
It appears that the PIO’s actions attract the penal provisions of Section 20 (1).
\nA showcause notice is being issued to him, and he is directed give his reasons to the
\nCommission to show cause why penalty should not be levied on him.\n<\/p>\n
He will give his written submissions showing cause why penalty should not be imposed
\non him as mandated under Section 20 (1) before 5 January, 2011. He will also send the
\ninformation sent to the appellant as per this decision and submit speed post receipt
\nas proof of having sent the information to the appellant.
\nThis decision is announced in open chamber.
\nNotice of this decision be given free of cost to the parties.
\nAny information in compliance with this Order will be provided free of cost as per Section 7(6) of RTI Act.\n<\/p>\n
