To issue a writ in the nature of mandamus directing the<br \/>\n       respondents to refund FDR of Rs.2.48 lacs without the condition<br \/>\n       of obtaining of NOC from Mining Department.<br \/>\n       B.      To issue a writ in the nature of mandamus directing the<br \/>\n       respondents to refund all the amount illegally deducted and<br \/>\n       detained under the head of royalty of minerals consumed.<br \/>\n       C.      To issue writ in the nature of mandamus directing the<br \/>\n       respondents to implement the judgment already passed by this<br \/>\n       Hon&#8217;ble High Court.&#8221;\n<\/p>\n<p>       The case of the petitioner is that the petitioner, after completion<br \/>\nof the works contract, furnished its bills for clearance, but the<br \/>\nrespondents are demanding royalty payment receipt from the petitioner<br \/>\nand has not cleared the bills of the petitioner.\n<\/p>\n<p>       It is submitted by Shri Jain that the controversy involved in this<br \/>\ncase is squarely covered by judgment of this Court. Aforesaid position is<br \/>\nnot disputed by the other side.\n<\/p>\n<p>       In Writ Petition No.9167\/10-M\/s Construction Association<br \/>\nGroup Partnership Firm Vs. The M.P. Police Housing Construction<br \/>\nCorpn.Ltd &amp; others decided on 19.7.2010, this Court considering<br \/>\nsimilar controversy passed an order, thus:-\n<\/p>\n<blockquote><p>    &#8220;Learned counsel for petitioner submitted that the controversy<br \/>\n    involved in this case is squarely covered by an order of this<br \/>\n    Court in W.P.No.1361\/09 M\/s Chandrama Construction<br \/>\n    Company Vs. M.P. Rajya Krishi Vipran Sangh &amp; others in<br \/>\n    which the learned Single Judge of this Court considering the<br \/>\n    controversy held thus:-\n<\/p><\/blockquote>\n<blockquote><p>            &#8220;The petitioner by way of present petition challenges<br \/>\n      the action of respondents who are deducting the royalty<br \/>\n      from bill of the petitioner despite the fact that he is not the<br \/>\n      owner of the Mine and is only a contractor, who purchases<br \/>\n      the material from the open market.<\/p><\/blockquote>\n<pre>\n<span class=\"hidden_text\">                                                                       2<\/span>\n\n\n\n\n                   W.P.No.10570\/10\n\nM\/s Naveen Kumar                           State of M.P. &amp; others\n\n\n\n\n9.8.2010\n<\/pre>\n<blockquote><p>            It is contended that the said action of the respondents<br \/>\n     is contrary to the law as laid down in W.P.No. 2535\/2003<br \/>\n     <a href=\"\/doc\/99933010\/\">(M\/s Ravi Construction Company V. State of M.P. and<br \/>\n     others<\/a>) wherein it was held that contractor engaged in<br \/>\n     construction work cannot be insisted to produce &#8220;No<br \/>\n     Objection Certificate&#8221; issued from the Office of the Collector<br \/>\n     (Mining), if they are not holder of mining lease and are<br \/>\n     purchasing material from open market.\n<\/p><\/blockquote>\n<blockquote><p>             Learned counsel appearing for respondents does<br \/>\n     not dispute that the issue in respect of furnishing the &#8220;No<br \/>\n     Objection Certificate&#8221; from Office of the Collector(Mining) by<br \/>\n     the contractor engaged in construction work have been<br \/>\n     settled at rest in number of judgments delivered by this<br \/>\n     Court. Accordingly it is submitted that the petition may be<br \/>\n     disposed of by the observation made in W.P.No.6266\/2006<br \/>\n     (M\/s     K.P.Singh      Bhadoria      V.    M.P.Rural     Road<br \/>\n     Development Authority Bhopal).\n<\/p><\/blockquote>\n<blockquote><p>             Having considered the submissions put forth by<br \/>\n     respective counsels and keeping in view the judgments<br \/>\n     rendered by this court in earlier given cases W.P.No.<br \/>\n     2535\/2003 <a href=\"\/doc\/99933010\/\">(M\/s Ravi Construction Company V. State of<br \/>\n     M.P. and others<\/a>), <a href=\"\/doc\/124331494\/\">W.P.No.6266\/2006 (M\/s K.P.Singh<br \/>\n     Bhadoria V. M.P. Rural Road Development Authority<br \/>\n     Bhopal) and W.P.7954\/2008 (M\/s Sunil Kumar Jain V.<br \/>\n     State of M.P. &amp;<\/a> 4 others) the present petition is disposed of<br \/>\n     with the following directions<br \/>\n        &#8220;(i) The State Government shall clear the bills of the<br \/>\n        petitioner submitted in connection with execution of<br \/>\n        the contract in question without insisting upon<br \/>\n        producing no dues certificate from the collector or<br \/>\n        any other authority with regard to payment of<br \/>\n        royalty for the minerals consumed. However, the<br \/>\n        State Government can insist upon production of<br \/>\n        bills with regard to purchase of mineral and in case<br \/>\n        the bill is not available an affidavit indicating the<br \/>\n        manner in which and the place or source from<br \/>\n        where the mineral is purchased. This affidavit can<br \/>\n        be used by the State Government for verification<br \/>\n        and for taking further action for clearing the bills.<\/p><\/blockquote>\n<p>       (ii) Amount of royalty, if any, recovered from the<br \/>\n       bills of the petitioner, shall be refunded to the<br \/>\n       petitioner on the petitioner filing the bill or the<br \/>\n       affidavit as indicated hereinabove. In case<br \/>\n       petitioner is unable to produce the bill or the<br \/>\n       affidavit as indicated hereinabove, liberty is granted<br \/>\n       to the petitioner to represent the matter before the<br \/>\n<span class=\"hidden_text\">                                                                         3<\/span><\/p>\n<p>                   W.P.No.10570\/10<\/p>\n<p>M\/s Naveen Kumar                            State of M.P. &amp; others<\/p>\n<p>9.8.2010<br \/>\n        State Government pointing out the inability in<br \/>\n        producing the bills or the affidavit and it would be<br \/>\n        for the State Government to consider the<br \/>\n        representation and take such steps as may be<br \/>\n        permissible or proper for clearing the bills in the<br \/>\n        given set of circumstances as may be indicated by<br \/>\n        the petitioners&#8221;.\n<\/p>\n<p>      In result the petition is allowed to the extent above. However<br \/>\n    no costs.&#8221;\n<\/p>\n<p>              It is submitted that in view of the aforesaid order, this<br \/>\n      matter may be disposed of finally.\n<\/p>\n<p>              As controversy involved in this case is squarely<br \/>\n      covered by the order in M\/s Chandrama Construction<br \/>\n      Company (supra) and we do not find any reason to differ<br \/>\n      with the reasonings and directions issued by the learned<br \/>\n      Single Judge, we dispose of this petition with following<br \/>\n      directions:-\n<\/p>\n<p>      (1)     The petitioner shall either furnish the bills of purchase<br \/>\n      of minerals from authorised dealer or an affidavit disclosing<br \/>\n      the source from where petitioner purchased minerals, which<br \/>\n      were used in the construction work.\n<\/p>\n<p>      (2)     The respondents authorities if are satisfied with the<br \/>\n      bills produced by the petitioner may process the bills, but in<br \/>\n      case of any doubt, respondents authorities may insist the<br \/>\n      petitioner to file an affidavit in support of its contention in<br \/>\n      respect of purchase of minerals from the open market by the<br \/>\n      bills.\n<\/p>\n<p>      (3)     In case the petitioner is unable to produce the bills for<br \/>\n      the purchase of the minerals or the royalty receipt in this<br \/>\n      regard, respondents authorities shall insist the petitioner to<br \/>\n      file an affidavit pointing out specifically the manner in which<br \/>\n      minerals were purchased, disclosing particulars of the person<br \/>\n      from whom the minerals were purchased. On filing of the<br \/>\n      affidavit, the authorities shall be within their right to verify the<br \/>\n      aforesaid facts. They can also verify the facts from the record<br \/>\n      of the Mining Department of the concerned district.<br \/>\n      (4)     On completion of the aforesaid process, the<br \/>\n      respondents shall clear the bills of the petitioner submitted in<br \/>\n      connection with the execution of the works contract and the<br \/>\n      amount of royalty, if any recovered from the bills, shall be<br \/>\n      released in favour of the petitioner.\n<\/p>\n<p>      (5)     In case, the authorities are not satisfied with the<br \/>\n      contention of petitioner or on verification, facts are not found<br \/>\n      correct then they shall pass a reasoned order in rejecting the<br \/>\n      contention of petitioner.<\/p>\n<pre>\n<span class=\"hidden_text\">                                                                                4<\/span>\n\n\n\n\n                         W.P.No.10570\/10\n\n     M\/s Naveen Kumar                             State of M.P. &amp; others\n\n\n\n\n     9.8.2010\n           (6)     If the petitioner fails to produce the bills\/affidavit as\n<\/pre>\n<p>           indicated hereinabove, the petitioner may represent his case<br \/>\n           to the concerned authority showing his inability to produce<br \/>\n           the bills or affidavit and it shall be for the State Government<br \/>\n           or authority to consider the representation and pass a<br \/>\n           suitable order in that regard.&#8221;\n<\/p>\n<p>            As controversy has been decided in Writ Petition No.9167\/10-<br \/>\n     M\/s Construction Association Group Partnership Firm               Vs. The<br \/>\n     M.P. Police Housing Construction Corpn.Ltd &amp; others, this petition<br \/>\n     is finally disposed of in terms of the directions issued in M\/s<br \/>\n     Construction Association Group Pa               rtnership Firm (supra).<br \/>\n     Aforesaid directions shall be applicable in the present case mutatis<br \/>\n     mutandis.\n<\/p>\n<p>            No order as to costs.\n<\/p>\n<p>            C.C. as per rules.<\/p>\n<pre>\n\n\n\n     (Krishn Kumar Lahoti)                                   (J.K.Maheshwari)\nC.
