No.11455 of 2011\n                           MAHESH PRASAD\n                                 Versus\n                         THE STATE OF BIHAR\n                                -----------\n<\/pre>\n<p>02.   27.04.2011           Petitioner being husband is apprehending his<\/p>\n<p>                   arrest in a complaint case in which cognizance has been<\/p>\n<p>                   taken under Sections 498A, 406, 323\/34 of the I.P.C.<\/p>\n<p>                           Learned    counsels    for   the     petitioner   and<\/p>\n<p>                   complainant, on instructions submit that both sides are<\/p>\n<p>                   ready for resumption of the conjugal life.<\/p>\n<p>                           Considering the aforesaid stands of the parties,<\/p>\n<p>                   let the petitioner namely Mahesh Prasad, in the event of<\/p>\n<p>                   his arrest or surrender before the Court below within a<\/p>\n<p>                   period of 12 weeks from today, be released on provisional<\/p>\n<p>                   bail for six months, on furnishing bail bond of Rs.<\/p>\n<p>                   10,000\/-(ten thousand) with two sureties of the like<\/p>\n<p>                   amount each to the satisfaction of S.D.J.M., Siwan in<\/p>\n<p>                   connection with Complaint Case No. 2059 of 2009.<\/p>\n<p>                           Let petitioner and complainant appear before<\/p>\n<p>                   learned Court below on 9th of May, 2011 when the<\/p>\n<p>                   petitioner will take the complainant to her matrimonial<\/p>\n<p>                   house to keep her as wife with full dignity and honour.<\/p>\n<p>                           The provisional anticipatory bail of the petitioner<\/p>\n<p>                   will be confirmed by the learned Court below on<\/p>\n<p>                   substantial restoration of the matrimonial harmony<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>          within a period of six months, or if the complainant<\/p>\n<p>          deliberately refuses to reside with the petitioner.<\/p>\n<pre>Shageer                                   ( Dinesh Kumar Singh, J)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Mahesh Prasad vs The State Of Bihar on 27 April, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
