                  this    revision    application       against     the   order<\/p>\n
                  dated    11.1.2011     passed    by    learned     Sessions<\/p>\n
                  Judge, East Champaran, Motihari in Cr. Revision<\/p>\n
                  No. 192 of 2010 by which the order dated 15th<\/p>\n
                  June 2010 passed by learned Juvenile Justice<\/p>\n
                  Board, Motihari in Case No. 560 of 2010 arising<\/p>\n
                  out of Kotwa P. S. Case No. 12 of 2010 under<\/p>\n
                  Section 302\/34 I.P.C., has been set aside.<\/p>\n
                             The      informant    lodged      an     FIR     on<\/p>\n
                  1.2.2010 stating therein that on 30.01.2010,<\/p>\n
                  her son Manoj Kumar had gone to play Cricket<\/p>\n
                  and during the game scuffle took place between<\/p>\n
                  the petitioner and Manoj. In the meantime, one<\/p>\n
                  Dukhi    Singh   along   with    Surendra    Mishra       went<\/p>\n
                  there and enquired about the scuffle, hearing<\/p>\n
                  the reason Dukhi Singh caught hold Manoj and<\/p>\n
                  the    petitioner    assaulted    Manoj     on    his   head.
\n                      2<\/span><\/p>\n
Manoj     was     taken         to     the     hospital          but     he<\/p>\n
succumbed       to       injuries.       After           investigation<\/p>\n
charge-sheet             was      submitted              against        the<\/p>\n
petitioner      under          Section       302    I.P.C..          During<\/p>\n
trial    a   petition           was    filed       before       Juvenile<\/p>\n
Justice      Board       to    declare        the       petitioner       as<\/p>\n
Juvenile. After holding enquiry, the Juvenile<\/p>\n
Justice      Board        declared           the        petitioner      as<\/p>\n
Juvenile. The informant filed Cr. Revision No.<\/p>\n
192 of 2010 in the Court of learned Sessions<\/p>\n
Judge. After hearing learned counsel for the<\/p>\n
parties, he has been pleased to set aside the<\/p>\n
order     dated          15.6.2010       passed           by     learned<\/p>\n
Juvenile Justice Board and the Juvenile Justice<\/p>\n
Board has been directed to pass a fresh order<\/p>\n
with    respect      to        juvenility          of    the    accused-<\/p>\n
petitioner after giving an opportunity to the<\/p>\n
informant\/prosecution to lead evidence.<\/p>\n
             Learned          counsel        for    the        petitioner<\/p>\n
has     submitted        that        admittedly          the    date    of<\/p>\n
occurrence      is       30.1.2010.          According          to   first<\/p>\n
attended     original           admission          register       of   the<\/p>\n
school and the school leaving certificate, the<\/p>\n
date of birth of the petitioner is 5.1.1995.<\/p>\n
The informant\/opposite party no. 2 has filed<\/p>\n
objection on 18.5.2010 to the petition filed by
\n                     3<\/span><\/p>\n
the      petitioner        for        declaration           of     his<\/p>\n
juvenility. The informant-opposite party no.2<\/p>\n
has    disputed     the    age    of     the    petitioner          and<\/p>\n
sought time to produce her evidence in support<\/p>\n
of    her   contention,        but     in     spite    of    several<\/p>\n
adjournments, no oral or documentary evidence<\/p>\n
was    adduced     or     produced.          After    enquiry       the<\/p>\n
petitioner was declared a juvenile under the<\/p>\n
provision     laid      down     in    the     Juvenile      Justice<\/p>\n
(Care and Protection of Children ) Act, 2000<\/p>\n
and Rules.\n<\/p>\n
            He     has     further       submitted          that     it\n\nappears     from    the    impugned          order    itself       that\n\n<\/pre>\n
accused petitioner in his petition has taken a<\/p>\n
plea that on the date of occurrence he was<\/p>\n
below 18 years of age. His date of birth is<\/p>\n
5.1.1995 and as such on the date of occurrence<\/p>\n
he    was   15     years    of        age.    Accoding       to     the<\/p>\n
informant,       the     date     of     birth        of    accused-<\/p>\n
petitioner         is     25.10.1992           in     the        school<\/p>\n
admission register of Hasanpur Primary School<\/p>\n
and the Juvenile Justice Board did not take<\/p>\n
pain to get the accused examined by Medical<\/p>\n
Board.\n<\/p>\n
            He has also contended that admittedly<\/p>\n
the occurrence is 30.1.2010. Even if the date
\n                      4<\/span><\/p>\n
of birth given by the informant as 25.10.1992<\/p>\n
is taken to be true, even then the petitioner<\/p>\n
is a juvenile. He has further submitted that<\/p>\n
the report of the medical board is not at all<\/p>\n
required in view of the provisions made in the<\/p>\n
Juvenile       Justice       (Care       and    Protection       of<\/p>\n
Children) Rules, 2007.\n<\/p>\n
            Learned        counsel       for    opposite     party<\/p>\n
no. 2 has submitted that the impugned order has<\/p>\n
been passed after hearing both the parties and<\/p>\n
it does not require any interference, but he<\/p>\n
could    not    controvert         the    contention       of   the<\/p>\n
petitioner      that       even     if    according     to      the<\/p>\n
informant the date of birth of the petitioner<\/p>\n
is 25.10.1992, even then the petitioner is a<\/p>\n
juvenile.\n<\/p>\n
            After        hearing     learned      counsel       for<\/p>\n
both the parties and on perusal of the material<\/p>\n
on record it appears that date of occurrence is<\/p>\n
30.1.2010. The date of birth of the petitioner<\/p>\n
according to school certificate is 5.1.1995.<\/p>\n
According to the informant, the date of birth<\/p>\n
of the petitioner mentioned in the admission<\/p>\n
register       of        Hasanpur     Primary       School      is<\/p>\n
25.10.1992. In that view of the matter also, on<\/p>\n
the     date    of       occurrence       the     age   of      the
\n                       5<\/span><\/p>\n
petitioner is below 18 years. According to Rule<\/p>\n
12(3) (a) of the Juvenile Justice (Care and<\/p>\n
Protection of Children) Rules, 2007, the date<\/p>\n
of    birth    mentioned         in    the    matriculation       or<\/p>\n
equivalent      certificate           or   the    date     of   birth<\/p>\n
certificate from the school first attended, and<\/p>\n
in absence thereof the birth certificate given<\/p>\n
by a corporation or a municipal authority or a<\/p>\n
panchayat has to be accepted and in absence of<\/p>\n
all   the     three,      the     medical     opinion      will   be<\/p>\n
sought from a duly constituted medical board.<\/p>\n
More or less the same provision is under Rule<\/p>\n
22    of      Bihar       Juvenile         Justice      (Care     and<\/p>\n
Protection        of            Children)         Rules,        2003.<\/p>\n
Accordingly      to       Rule    22(5)      of   Bihar    Juvenile<\/p>\n
Justice       (Care       and     Protection       of     Children)<\/p>\n
Rules, 2003, the medical opinion regarding the<\/p>\n
age will be taken only in absence of; (i) a<\/p>\n
birth certificate given by a corporation or a<\/p>\n
municipal authority; or (ii) a date of birth<\/p>\n
certificate from the school first attended; or<\/p>\n
(iii) matriculation or equivalent certificate,<\/p>\n
if available. It appears from the order dated<\/p>\n
15.6.2010 passed by learned Juvenile Justice<\/p>\n
Board that informant had filed                    objection dated<\/p>\n
18.5.2010 regarding the age of the accused but
\n                             6<\/span><\/p>\n
          even after having being given sufficient time,<\/p>\n
          no    document     was    filed      on    behalf      of   the<\/p>\n
          informant. After considering the materials on<\/p>\n
          record, learned Juvenile Justice Board has held<\/p>\n
          that the age of the petitioner was less than 18<\/p>\n
          years on the date of occurrence and as such he<\/p>\n
          was declared a juvenile.\n<\/p>\n
                     Considering            the        facts          and<\/p>\n
          circumstances stated above, in my opinion, the<\/p>\n
          impugned      order     passed    by      learned      Sessions<\/p>\n
          Judge, East Champaran Motihari is not fit to be<\/p>\n
          sustained.       The impugned order is set aside.<\/p>\n
          The   order     dated    15.6.2010      passed    by   learned<\/p>\n
          Juvenile Justice Board, Motihari, is restored.<\/p>\n
