      Common issues arise for consideration in these<\/p>\n
two writ petitions and therefore, they have been heard<\/p>\n
together and are being disposed of by a common<\/p>\n
judgment.\n<\/p>\n<\/p>\n
2.    I heard Mr.C.S.Ajith Prakash          and Mr.Sajjad,<\/p>\n
learned counsel for the petitioners in the writ petitions<\/p>\n
and Mr.T.A.Shaji learned Standing Counsel for the<\/p>\n
University. I will refer to the facts in Writ Petition<\/p>\n
No.34352\/2008, which are substantially similar to the<\/p>\n
facts involved in the other writ petition also.<\/p>\n
3.    Petitioner is an M.Tech student prosecuting his<\/p>\n
course in a College affiliated to M.G.University. The<\/p>\n
Course is spread over four semesters. Ext.P8 is the<\/p>\n
regulations framed by the University governing M.Tech<\/p>\n
Course. Petitioner is a good student who had cleared<\/p>\n
all the papers in the 1st semester.         But in the 2nd<\/p>\n

semester, he was disabled from appearing for one of the<\/p>\n
papers due to medical reasons. He was able to acquire a<\/p>\n
good average going by the results in the other papers<\/p>\n
alone.    Petitioner  cleared all the papers in    the 3rd<\/p>\n
semester and has come to the end of the 4th semester.<\/p>\n
But his hall ticket is withheld due to the reason that he<\/p>\n
has not cleared all the papers in the 2nd semester. In the<\/p>\n
case of the petitioner, it is a reason beyond his control<\/p>\n
which prevented him from appearing in one of the<\/p>\n
papers in the 2nd semester examination. He has actually<\/p>\n
appeared in the said paper in the supplementary<\/p>\n
examination held in November, 2008.\n<\/p>\n<\/p>\n
4.    Regulation    in   question  which    disables   the<\/p>\n
petitioners     from  appearing   in  the   4th  semester<\/p>\n
examination is contained in clause 11, which reads as<\/p>\n
follows:-\n<\/p>\n<\/p>\n
                 Evaluation     of       industrial<\/p>\n
           training\/masters research project work<\/p>\n
           will be taken up only after the student<\/p>\n
           completes the entire core subjects as<\/p>\n

           well as elective subjects requirements.<\/p>\n
           However, the candidates are eligible to<\/p>\n
           appear for the Masters Comprehensive<\/p>\n
           viva     only   after   the  successful<\/p>\n
           completion of the first three semesters<\/p>\n
           of the masters programme.\n<\/p>\n<\/p>\n
5.    Mr.Ajith Prakash learned counsel appearing for the<\/p>\n
petitioner submits that distinction will have to be drawn<\/p>\n
between the first and second limb of clause which says<\/p>\n
that evaluation of Industrial training\/masters research<\/p>\n
project work will be taken up only after the student<\/p>\n
completes the entire core subjects as well as elective<\/p>\n
subjects requirements.     According to him,   successful<\/p>\n
completion of the first three semesters can be treated as<\/p>\n
a requirement only for appearing in the           Masters<\/p>\n
Comprehensive Viva voce. Assuming this be so, the 4th<\/p>\n
semester is divided into two parts, one is the Evaluation<\/p>\n
of the Industrial training\/Masters research project and<\/p>\n
the other is Masters      Comprehensive Viva.    It would<\/p>\n
serve no purpose to undergo evaluation of the training of<\/p>\n
the Masters Research Project alone if at the same time,<\/p>\n

it disables the student from participating in the Masters<\/p>\n
Comprehensive Viva.       I do not find anything in the<\/p>\n
regulation which spells out a dilution in so far as the<\/p>\n
requirement “successful completion of the first three<\/p>\n
semesters      to secure the eligibility to appear in the<\/p>\n
Masters Comprehensive Viva”. No doubt, in the case of<\/p>\n
the petitioner’s, good students who were prevented from<\/p>\n
appearing in one of the examinations in the 2nd semester<\/p>\n
due to medical reasons, are visited with a hardship. But<\/p>\n
I do not find any provision which contemplates a dilution<\/p>\n
of the requirements. Though, it may be the misfortune<\/p>\n
of the petitioner that he is not able to participate in the<\/p>\n
4th semester examination, I can interfere only if I am<\/p>\n
able to find     any illegality in the stand taken by the<\/p>\n
University and this I am not able to do.<\/p>\n
6.    Learned counsel for the petitioner submits that one<\/p>\n
student who was similarly situated in the previous year<\/p>\n
was so permitted to appear in the last without clearing<\/p>\n
all the earlier papers.     On instructions, Mr.T.A.Shaji,<\/p>\n
learned Standing Counsel for the University, submits<\/p>\n

that it is true that the student who had not cleared all<\/p>\n
the papers in the 3rd semester was permitted to<\/p>\n
participate in the 4th semester examination on a<\/p>\n
provisional basis. But it was later found that she was not<\/p>\n
eligible and     her participation was cancelled as well.<\/p>\n
Mr.Ajith Prakash submits that said cancellation was<\/p>\n
because she had failed to clear the papers and not<\/p>\n
because she was found ineligible, at a later stage. This<\/p>\n
aspect is disputed by the learned counsel for the<\/p>\n
University.\n<\/p>\n<\/p>\n
7.    I do not propose to conduct an enquiry on this<\/p>\n
aspect in as much as the University cannot be faulted<\/p>\n
with for implementing the regulations. If a wrong was<\/p>\n
committed earlier, that does not afford a justification<\/p>\n
for this Court to direct the University to perpetuate the<\/p>\n
mistake.\n<\/p>\n<\/p>\n
8.    The Supreme Court and a Bench of this Court had<\/p>\n
repeatedly held that regulations in academic matters<\/p>\n
cannot be permitted to be diluted. If that be so, I do not<\/p>\n

find my way to issue any direction to the University.<\/p>\n
Writ petitions are bereft of merit and hence dismissed.<\/p>\n
