Scheme No.12 of Nizampura,<br \/>\nVadodara by a registered sale deed from one Ashokkumuar Ishwardas.<br \/>\nThe Collector, Vadodara by his order dated 30\/06\/1992 granted NA<br \/>\nPermission under the provisions of Section 65 of the Bombay Land<br \/>\nRevenue Code of the land in question and the Vadodara Municipal<br \/>\nCorporation has also granted permission to construct upon the said<br \/>\nland.  However, the Collector by its order dated 24\/05\/1993 ordered<br \/>\nto remove construction made on the plot, against which petitioner had<br \/>\npreferred a Revision Application before the Deputy Secretary<br \/>\n(Appeals)which came to be dismissed.  Hence the present petition.\n<\/p>\n<p>4.\t\tThe<br \/>\ncontention of the learned Advocate for the petitioner is that<br \/>\npetitioner was a bona-fide purchaser of the plot No.497 for the value<br \/>\nwithout notice and respondent No.2 ought not to have held that<br \/>\nconstruction was on the common plot and is required to be removed.<br \/>\nIt is contended that as such there is no Co-operative Society<br \/>\nregistered and therefore in the Final Plot where there are different<br \/>\nplots, question would not arise to keep the common plot. It is lastly<br \/>\nsubmitted that respondent No.1 having failed to obtain injunction<br \/>\nfrom the competent Civil Court, made a representation before the<br \/>\nCollector who in turn passed the order of removal of constitution<br \/>\nmade in Final Plot No.497 without giving any opportunity to the<br \/>\npetitioner to show cause or of hearing.\n<\/p>\n<p>5.\t\tHaving<br \/>\nheard the learned Advocate for the petitioner and having perused the<br \/>\norders passed by both the authorities below, this Court is the<br \/>\nopinion that both the authority have categorically held that common<br \/>\nplot was sanctioned with NA Permission which can be proved from<br \/>\nAnnexure &#8211; A VII issued by the Deputy Town Planning Officer,<br \/>\nVadodara Municipal Corporation. The revisional authority has<br \/>\nspecifically held that permission qua 16 % was given by the<br \/>\nCorporation for the purpose of common plot utility and not for misuse<br \/>\nof it by way of selling.  It is of the joint ownership of the plot<br \/>\nholders as well as in the map of original Town Planning Scheme<br \/>\nwherein the Final Plot No.497 is shown as reserved land for garden.<br \/>\nTherefore, the orders passed by the authorities below are just and<br \/>\nproper and do not require to be interfered with.\n<\/p>\n<p>6.\t\tThis<br \/>\nCourt is in complete agreement with the findings arrived at by the<br \/>\nauthorities below.  The petition is therefore dismissed. Rule is<br \/>\ndischarged with no order as to costs.
