L.B.DABHI, APP for Respondent(s) :\n1, \nNone for Respondent(s) :\n2, \n========================================= \n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE A.M.KAPADIA\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE BANKIM.N.MEHTA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 08\/02\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE A.M.KAPADIA)<\/p>\n<p>RULE.\n<\/p>\n<p>Mr.\n<\/p>\n<p>\tL.B.Dabhi, learned APP appears and waives service of notice of Rule<br \/>\n\ton behalf of the Respondent &#8211; State of Gujarat.\n<\/p>\n<p>Having<br \/>\n\tregard to the facts of the case, the application is taken up for<br \/>\n\thearing today.\n<\/p>\n<p>The<br \/>\n\tApplicant &#8211; convict, who vide judgment and order dated<br \/>\n\t23.11.2006 rendered in Sessions Case No. 107 of 2006 by the learned<br \/>\n\tAdditional Sessions Judge, Mehsana, has been convicted<br \/>\n\tfor the offence punishable under Section 302, etc. of the Indian<br \/>\n\tPenal Code, has filed this Application through jail authority,<br \/>\n\tpraying for suspension of sentence and to release him on regular<br \/>\n\tbail during the pendency and final hearing of the above numbered<br \/>\n\tCriminal Appeal.  Alternatively, it is also prayed for expeditious<br \/>\n\thearing of the above numbered Criminal Appeal.\n<\/p>\n<p>Having<br \/>\n\tconsidered the submission advanced by Mr. L.B.Dabhi, learned APP for<br \/>\n\tthe Respondent &#8211; State of Gujarat and upon perusal of the<br \/>\n\tjudgment and order of conviction and sentence recorded against the<br \/>\n\tApplicant for the offence under Section 302 of IPC, we have noticed<br \/>\n\tthat the case against the Applicant is based on testimony of minor<br \/>\n\teyewitness Govindji and there is no reason to disbelieve his oral<br \/>\n\ttestimony.  Therefore, according to us, primafacie, the decision of<br \/>\n\tthe trial Court convicting the Applicant under Section 302 IPC<br \/>\n\tcannot be regarded as erroneous at this stage.\n<\/p>\n<p>The<br \/>\n\tSupreme Court in several recent decisions has cautioned the High<br \/>\n\tCourts that after conviction of an accused under section 302, the<br \/>\n\trelief of regular bail should not  be granted by the High Courts.<br \/>\n\tReference can be made to the decisions rendered in case of (1)<br \/>\n\tJADEJA AJITSINH NATUBHA AND ORS. Vs. STATE OF GUJARAT, 21 GLR 571,<br \/>\n\t(2) STATE OF HARYANA VS.HASMAT, (2004)6 SCC  175,(3) S.JEEVANANTHAM<br \/>\n\tVS. STATE THROUGH INSPECTOR OF POLICE, T.N. (2004) 5 SCC 230, (4)<br \/>\n\t<a href=\"\/doc\/1092777\/\">STATE Represented By Inspector Of Police, Vigilance &amp;<br \/>\n\tAnti-Corruption, Tiruchirapalli, T.N. Vs. V. JAYAPAUL<\/a> (2004) 5 SCC<br \/>\n\t223 and (5) KISHORI LAL<br \/>\n\tVs. RUPA AND OTHERS (2004) 7 SCC 638.  Therefore, the prayer for<br \/>\n\tsuspension of sentence and to release the Applicant convict on<br \/>\n\tregular bail during the pendency and final hearing of the above<br \/>\n\tnumbered Criminal Appeal cannot be entertained.\n<\/p>\n<p>\tSo far as<br \/>\n\talternative prayer for expeditious hearing of the above numbered<br \/>\n\tCriminal Appeal is concerned, this Court vide order dated 10.2.2010<br \/>\n\trendered in Criminal Misc.
