P.C.,<br \/>\n\tagainst the Judgment and order dated 8.2.2011, rendered in Criminal<br \/>\n\tCase No.3852 of 2000 by the learned 6th Additional Chief<br \/>\n\tJudicial Magistrate, Junagadh. The said case was registered against<br \/>\n\tthe present respondent Nos.2 to 4 &#8211; original accused for the<br \/>\n\toffence under section  16 of the Prevention of Food Adulteration Act<br \/>\n\t(for short &#8220;PFA Act&#8221;) in the Court of learned 6th<br \/>\n\tAdditional Chief Judicial Magistrate, Junagadh. The said Judgment of<br \/>\n\tthe trial Court has been challenged by the Food Inspector on the<br \/>\n\tground that the Judgment and order passed by learned Magistrate is<br \/>\n\tagainst the law and evidence on record.\n<\/p>\n<p>\tAccording to the<br \/>\n\tprosecution case, the complainant &#8211; Food Inspector visited the<br \/>\n\tshop of respondents &#8211; accused on 8.5.2000 at 6 o&#8217;clock in the<br \/>\n\tevening alongwith Panchas and witness, and took sample of 750 gram<br \/>\n\tMava for the purpose of analysis. The panchnama was also prepared.<br \/>\n\tThereafter, after completing the necessary procedure, the<br \/>\n\tcomplainant sent the said samples to the Public Analyst for<br \/>\n\tanalysis. The Public Analyst submitted the report in which it has<br \/>\n\tbeen found that the sample is adulterated.  Upon receipt of the<br \/>\n\treport the complainant, after obtaining sanction, filed complaint<br \/>\n\tagainst the respondents &#8211; original accused for breach of<br \/>\n\tSection 7(1) of the Act and thereby the accused has committed an<br \/>\n\toffence under Section  16 of the Act in the Court of learned 6th<br \/>\n\tAdditional Chief Judicial Magistrate, Junagadh, being Criminal Case<br \/>\n\tNo. 3852 of 2000.\n<\/p>\n<p>\tAt the conclusion of<br \/>\n\ttrial and after appreciating the oral as well as documentary<br \/>\n\tevidence, the learned Magistrate vide impugned Judgment, acquitted<br \/>\n\tthe respondents &#8211; accused.\n<\/p>\n<p>\tMr.Pujara, learned<br \/>\n\tadvocate appearing for Mr.A.M.Dagli, for the appellant &#8211; Food<br \/>\n\tInspector has contended that the judgment and order of acquittal is<br \/>\n\tcontrary to law and evidence on record and is not proper. He has<br \/>\n\tcontended that Mava of 750 gram was taken as sample from the<br \/>\n\trespondent No.2 firm and was sent for public analysis report, and<br \/>\n\tafter receiving report it was found that the sample, which was sent<br \/>\n\tfor analysis, was adulterated one. He has  contended that the trial<br \/>\n\tCourt has failed to appreciate the report of Public Analyst. He has<br \/>\n\talso contended that the offences punishable under the Act are<br \/>\n\tdirectly connected with the health of public at large.\n<\/p>\n<p>\tI have gone through the<br \/>\n\tpapers produced in the Case. I have also gone through the evidence<br \/>\n\tled before the trial Court as well as the Expert Opinion. I have<br \/>\n\talso gone through the Judgment of the trial Court. I have also<br \/>\n\tperused report. It appears from the procedure adopted by the<br \/>\n\tappellant &#8211; original complainant that procedure as per Section<br \/>\n\t11(1)(C) of the Act was not followed.  Learned Counsel for the<br \/>\n\tappellant is unable to convince this Court as to whether the<br \/>\n\tprosecution has followed the mandatory provision of Rules. In the<br \/>\n\tfacts of the case I am in complete agreement with the reasons<br \/>\n\tassigned by the trial Court.\n<\/p>\n<p>\tIt is settled legal<br \/>\n\tposition that in acquittal Appeal, the Appellate Court is not<br \/>\n\trequired to re-write the Judgment or to give fresh reasonings when<br \/>\n\tthe Appellate Court is in agreement with the reasons assigned by the<br \/>\n\ttrial Court acquitting the accused. In the instant case, this Court<br \/>\n\tis in full agreement with the reasons given and findings recorded by<br \/>\n\tthe trial Court while acquitting the respondents &#8211; accused and<br \/>\n\tadopting the said reasons and for the reasons aforesaid, in my view,<br \/>\n\tthe impugned Judgment is just, legal and proper and requires no<br \/>\n\tinterference by this Court at this stage. Hence, this Appeal<br \/>\n\trequires to be dismissed.\n<\/p>\n<p>In<br \/>\n\tthe result, the Appeal is hereby dismissed. The impugned Judgment<br \/>\n\tand order dated 8.2.2011 passed by the learned 6th<br \/>\n\tAdditional Chief Judicial Magistrate, Junagadh, in Criminal Case<br \/>\n\tNo.3852 of 2000, acquitting the respondents  &#8211;
