Civil Application under Section 24 of the Code of Civil<br \/>\n\tProcedure for seeking transfer of the said proceedings to that of<br \/>\n\tFamily Court, Rajkot, where, she resides after separating from the<br \/>\n\trespondent husband on account of serious dispute.\n<\/p>\n<p>This<br \/>\n\tCourt (Coram: Ravi R. Tripathi, J.) vide order dated 05.08.2010<br \/>\n\tissued Rule, which was made returnable on 14.09.2010. The husband<br \/>\n\trespondent hereinabove has been represented by an advocate and an<br \/>\n\taffidavit-in-reply has come on record.\n<\/p>\n<p>Shri<br \/>\n\tJasani, learned advocate appearing for the applicant wife placed<br \/>\n\treliance upon the decision of the Supreme Court in case of  Sumita<br \/>\n\tSingh Vs. Kumar Sanjay, reported in  2001 (10)<br \/>\n\tSCC 41 = AIR 2002 SC 396 and Section 19 of the Hindu<br \/>\n\tMarriage Act, 1955, submitted that in no case the maintenance<br \/>\n\tpetition should have been maintained at Morbi.\n<\/p>\n<p>Learned<br \/>\n\tadvocate Shri Majmudar appearing for the respondent husband has<br \/>\n\tcontended that applicant is not justified in seeking transfer as<br \/>\n\teven as per the averments made in the Hindu Marriage Petition, more<br \/>\n\tparticularly in para-6, it indicates that the couple lastly resided<br \/>\n\ttogether at Morbi only. This fact couple with the fact that wife has<br \/>\n\tnot preferred any application on this court for ousting the<br \/>\n\tjurisdiction of Morbi, would go to show that the applicant has no<br \/>\n\tright to plead Section 19 of the Hindu Marriage Act into service. So<br \/>\n\tfar as inconvenience on the part of applicant, Shri Majmudar has<br \/>\n\tsubmitted that the respondent husband is ready and willing to bare<br \/>\n\tthe cost of traveling so as to help the wife in traveling from<br \/>\n\tRajkot to Morbi for attending the proceedings. Beside this, Shri<br \/>\n\tMajmudar has submitted that as stated in the affidavit-in-reply, the<br \/>\n\thusband has also expressed that the wife has strong influence at<br \/>\n\tRajkot, which also held militating against maintaining the transfer<br \/>\n\tpetition.\n<\/p>\n<p>This<br \/>\n\tCourt has heard learned advocates for the parties at length and<br \/>\n\tperused the rival contention as emerged from the record and<br \/>\n\taffidavit-in-reply. The husband has filed an application seeking<br \/>\n\tdivorce from the wife and in view of the decision of the Apex Court<br \/>\n\tin case of Sumita Singh Vs. Kumar Sanjay, reported in 2001(10) SCC<br \/>\n\t41, the wife&#8217;s inconvenience is to be looked into and not the<br \/>\n\thusband. Beside section 19 also, enjoin the parties to file petition<br \/>\n\teither at the place where parties to the marriage last resided<br \/>\n\ttogether or where the wife is the petitioner, where she is residing<br \/>\n\ton the date of presentation of the petition. In the instant case,<br \/>\n\tadmittedly, the wife is lastly resided at Rajkot only. The<br \/>\n\tpreparedness of the respondent husband to meet with the traveling<br \/>\n\texpenses are not to be a ground for rejecting the transfer petition.<br \/>\n\tThe applicant wife has shown her inconvenience as stated in the memo<br \/>\n\tof application and I do not intend to dwell elaborately upon the<br \/>\n\trival contentions as it may affect the parties inter-se dispute and<br \/>\n\trival contentions before the concerned Court. The Misc. Civil<br \/>\n\tApplication is required to be allowed and is allowed. The Hind<br \/>\n\tMarriage Petition No. 16 of 2010 pending before the Court of learned<br \/>\n\tPrincipal Civil Judge, Morbi is ordered to be transferred to the<br \/>\n\tFamily Court, Rajkot and registry of Family Court, Rajkot is<br \/>\n\tdirected to give fresh number and parties be informed accordingly<br \/>\n\tabout the date. Rule is made absolute to the aforesaid extent.
