Rule.\n<\/p>\n<p>2. With the consent of the parties the matter is<br \/>\ntaken up for final hearing.\n<\/p>\n<p>3. The main grievance of the learned counsel for the<br \/>\npetitioner is that the impugned order at Annexure P-6 has<br \/>\nkeeps in abeyance the agreement of empanelment of the<br \/>\npetitioner dated 20th\/22nd June, 2001, without giving any<br \/>\nshow cause notice or opportunity of hearing to the<br \/>\npetitioner and since the impugned order visits the<br \/>\npetitioner with civil consequences, the petitioner ought<br \/>\nto have been afforded an opportunity of being heard and<br \/>\nin absence of a show cause notice, the impugned action is<br \/>\nclearly in violation of principles of natural justice.<br \/>\nThe learned counsel for the respondent states that a show<br \/>\ncause notice shall be issued to the petitioner within two<br \/>\nweeks from today. Reply thereto shall be filed within<br \/>\none week thereafter. The response to show cause notice<br \/>\nshall be considered and disposed of by the respondent<br \/>\nwithin two weeks thereafter.\n<\/p>\n<p>4. Learned counsel for the respondent states that if<br \/>\nthe response of the petitioner is found to be<br \/>\nsatisfactory and no action is contemplated against the<br \/>\npetitioner, the petitioner shall be entitled to<br \/>\nempanelment for the term stipulated int he agreement of<br \/>\nempanelment dated 20\/22nd June, 2001 and would be<br \/>\nentitled to empanelment for an appropriate period so as<br \/>\nto complete the empanelment for a one year term.\n<\/p>\n<p>5. The petition accordingly stands disposed of.
