PATTANAIK (J)\n\nCITATION:\n JT 1996 (7)   708\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Leave granted<br \/>\n     We have heard learned counsel for the parties.<br \/>\n     This appeal  by special  leave arises from the order of<br \/>\nthe  Karnataka\t Administrative\t Tribunal,  Bangalore  dated<br \/>\n1.2.1992 made on Application No.1961\/90. Admittedly when the<br \/>\nappellant was  working as  s Tehsildar an adverse remark has<br \/>\nbeen made for the year 1988-89 as under :-\n<\/p>\n<blockquote><p>     &#8220;Competent, good  at  getting  work<br \/>\n     done,    but     does    not    act<br \/>\n     dispassionately  when   faced  with<br \/>\n     dilemma.&#8221;<\/p><\/blockquote>\n<p>     Calling that  in question,\t the appellant filed O.A. It<br \/>\nis now\tlaw that  the object of making adverse remarks is to<br \/>\nassess\tthe   competence  of   an  officer   on\t merits\t and<br \/>\nperformance of\tan officer  concerned so as to grade him, to<br \/>\nvarious\t categories   as  outstanding,\t very  good,   good,<br \/>\nsatisfactory and  average etc.\tThe competent  authority and<br \/>\nthe reviewing authority have to act fairly or objectively on<br \/>\nassessing the  character, integrity  and performance  of the<br \/>\nincumbent. It  is seen\tthat in\t the review  order,  various<br \/>\ngrounds on  which the  various criteria\t are to\t be complied<br \/>\nwith were specifically noted thus :\n<\/p>\n<blockquote><p>     &#8220;3. A  perusal of Annexure -A1 goes<br \/>\n     to show  that in  the  aspects  the<br \/>\n     work   of\t  the\t Applicant    is<br \/>\n     satisfactory. According to the form<br \/>\n     in which  the confidential\t remarks<br \/>\n     of the  officers is  to be written,<br \/>\n     the reporting  officer is\trequired<br \/>\n     to indicate  his assessment  of the<br \/>\n     officer on the following aspects of<br \/>\n     his work :\n<\/p><\/blockquote>\n<blockquote><p>     1. Knowledge of work;\n<\/p><\/blockquote>\n<blockquote><p>     2. Power of expression;\n<\/p><\/blockquote>\n<blockquote><p>     3.Power of acquiring general<br \/>\n\t  information;\n<\/p><\/blockquote>\n<blockquote><p>     4. Attention to detail;\n<\/p><\/blockquote>\n<blockquote><p>     5. Industry;\n<\/p><\/blockquote>\n<blockquote><p>     6. Judgment;\n<\/p><\/blockquote>\n<blockquote><p>     7. speed of disposal;\n<\/p><\/blockquote>\n<blockquote><p>     8.Willingness to accept<br \/>\n     responsibility and to take<br \/>\n     decision;\n<\/p><\/blockquote>\n<blockquote><p>     9. Relationship  with  subordinates<br \/>\n     and colleagues;\n<\/p><\/blockquote>\n<blockquote><p>     10. Public relations;\n<\/p><\/blockquote>\n<blockquote><p>     11. Integrity.\n<\/p><\/blockquote>\n<blockquote><p>     The  report  about\t all  the  above<br \/>\n     aspects is\t satisfactory. There  is<br \/>\n     no adverse\t report about integrity.<br \/>\n     However, the  underlined remarks in<br \/>\n     Annexure-A1  are\tmade.  the  last<br \/>\n     sentence in those remarks indicates<br \/>\n     that the  intention of  the officer<br \/>\n     who  wrote\t those\tremarks\t was  to<br \/>\n     treat the\tremarks as  advisory. He<br \/>\n     has stated\t that the officer should<br \/>\n     evince more  interest. When all the<br \/>\n     ten aspects  of the  work which are<br \/>\n     required  to  be  assessed\t by  the<br \/>\n     rules are\tsatisfactory the alleged<br \/>\n     adverse  remarks  get  considerably<br \/>\n     diluted   and   we\t  are\tof   the<br \/>\n     considered opinion\t  that\tends  of<br \/>\n     justice would  have served\t of  the<br \/>\n     remarks  are  treated  as\tadvisory<br \/>\n     with a  direction that  they should<br \/>\n     not be  made  use\tof  against  the<br \/>\n     Applicant for any purpose.&#8221;<\/p><\/blockquote>\n<p>     It was found that his integrity was not doubted and his<br \/>\nwork  also   in\t all   those  respects\t was  found   to  be<br \/>\nsatisfactory. Under  those circumstances, the remark that he<br \/>\n&#8220;does not  act dispassionately then faced with dilemma&#8221; must<br \/>\nbe pointed out with reference to specific instances in which<br \/>\nhe did not perform that duty satisfactorily so that he would<br \/>\nhave an\t opportunity to\t correct himself of the mistake . He<br \/>\nshould be  given an  opportunity   in the cases where he did<br \/>\nnot work  objectively or satisfactorily. Admittedly, no such<br \/>\nopportunity was\t given. Even  when he  acted in\t dilemma and<br \/>\nlacked objectivity,  in such  circumstances  ,\the  must  be<br \/>\nguided by  the authority  as to the manner in which he acted<br \/>\nupon. Since  this exercise has been done by the respondents,<br \/>\nit would  be obvious  that the\tabove adverse remark was not<br \/>\nconsistent with law.\n<\/p>\n<p>     Accordingly the appeal is allowed. The adverse remark<br \/>\nstands expunged.
