No.1644 of 2011\n                                  BRIJNANDAN SINGH\n                                           Versus\n                                THE STATE OF BIHAR\n                                         -----------\n<\/pre>\n<p>2   25.02.2011               Heard Mr. Ajay Kumar Thakur, learned counsel<\/p>\n<p>                 appearing for the petitioner and Mr. U. S. Singh learned counsel<\/p>\n<p>                 appearing for the state.\n<\/p>\n<p>                             Petitioner is facing trial in connection with Sessions<\/p>\n<p>                 Trial No. 1682 of 2009 arising out of Khusrupur P.S. Case No.<\/p>\n<p>                 46 of 2009 in the court of Additional Sessions Judge-II, Patna<\/p>\n<p>                 City.\n<\/p>\n<p>                             The contention of learned counsel for the petitioner is<\/p>\n<p>                 that the petitioner is in jail custody since 18.03.2009 and uptill<\/p>\n<p>                 now, only four witnesses have been examined in this case and<\/p>\n<p>                 all the above-said prosecution witnesses have not made any<\/p>\n<p>                 allegation against the petitioner.\n<\/p>\n<p>                             It appears from perusal of the record that the petitioner<\/p>\n<p>                 is said to be main assailant and still some prosecution<\/p>\n<p>                 witnesses are left to be examined.\n<\/p>\n<p>                             In the aforesaid circumstances, I do not feel it proper<\/p>\n<p>                 to enlarge the petitioner on bail.\n<\/p>\n<p>                             Accordingly, prayer for bail of the petitioner stands<\/p>\n<p>                 rejected.\n<\/p>\n<p>                             However, learned trial court is directed to conclude the<\/p>\n<p>                 trial of the petitioner as soon as possible preferably within a<br \/>\n<span class=\"hidden_text\">                             -2-<\/span><\/p>\n<p>        period of nine months and if the aforesaid trial is not concluded<\/p>\n<p>        within the above-said period, the petitioner may renew his<\/p>\n<p>        prayer for bail.\n<\/p>\n<\/p>\n<pre>AKV\/-                                (Hemant Kumar Srivastava,J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Brijnandan Singh vs The State Of Bihar on 25 February, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
