Respondents.\n                                     -----------\n<\/pre>\n<p>2.     28.09.2010                Having heard learned counsel for the parties as<\/p>\n<p>                        with regard to the following relief<\/p>\n<p>                                           &#8220;i) To direct the respondent<br \/>\n                                 authority to appoint the petitioner on the post<br \/>\n                                 of \u201ePanchayat Teacher\u201f of Machchagarh<br \/>\n                                 Lakshiram Panchayat.\n<\/p>\n<p>                                           In view of the fact that the petitioner<br \/>\n                                 had applied for the post of \u201ePanchayat<br \/>\n                                 Teacher\u201f of Machchagarh Lakshiram<br \/>\n                                 Panchayat and for that he was submitted his<br \/>\n                                 application form before Panchayat Sewak<br \/>\n                                 (Resp. No.-7) and against that receipt vide its<br \/>\n                                 No. 57 had given to him and accordingly he<br \/>\n                                 appeared for counselling on 30.11.06 and the<br \/>\n                                 serial no. of the petitioner in counselling<br \/>\n                                 register was marked as 37 but the another<br \/>\n                                 person who was lesser marks holder selected<br \/>\n                                 for that post due to oblique reason.&#8221;<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>                     this Court is of the considered opinion that the<\/p>\n<p>            grievance of the petitioner in the first instance has to be<\/p>\n<p>            looked into by the District Teachers\u201f Appellate Authority<\/p>\n<p>            and therefore this writ application is disposed of with a<\/p>\n<p>            liberty to the petitioner to approach the said authority by<\/p>\n<p>            filing a complaint.\n<\/p>\n<p>                     It is however made clear that if the petitioner<\/p>\n<p>            would file a complaint within a period of one month from<\/p>\n<p>            today, the same shall be disposed of on merits after giving<\/p>\n<p>            opportunity of hearing to the petitioner and respondent no.<\/p>\n<p>            9 without going into the question of delay keeping in view<\/p>\n<p>            that this writ application had remained pending since<\/p>\n<p>            28.2.2007.\n<\/p>\n<p>                     With    the   aforementioned     observations   and<\/p>\n<p>            directions, this writ application is disposed of.<\/p>\n<pre>kanchan\/-                            (Mihir Kumar Jha, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Kamleshwar Yadav vs The State Of Bihar &amp;Amp; Ors on 28 September, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA CWJC No.2659 of 2007 KAMLESHWAR YADAV, son of Sri Ram Awatar Yadav, resident of village- Badheyan, Panchayat- Machchagarh Lakshiram, Tola- Barauli, PS- Mirganj, District- Gopalganj. &#8230; Petitioner.
